Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION - DE-AM04-03AL67577 JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Unusual & Compelling Urgency I.REQUESTING OFFICE. The National Nuclear Security Administration (NNSA) Service Center in Albuquerque, New Mexico, plans to contract by means other than full and open competition per the Competition in Contracting Act (CICA) of 1984 on behalf of the Office of Secure Transportation (OST) for a range of paramilitary training to maintain its Federal agent workforce. OST is responsible for the safe and secure transport of nuclear weapons, special nuclear materials, and weapons components between production facilities and Department of Defense facilities via surface and air modes of transportation by Federal agents. II.NATURE OF ACQUISITION. This is a sole source acquisition for a three month extension with one three-month extension option to the current Master Contract DE-AM04-03AL67577 and the associated active Task Orders NA99020 (Training and Logistics), NA99022 (Contractor Transportation Utilization Program (CTUP)), and NA25205 (Work for Others) with Wackenhut Services, Inc. (WSI) of Palm Beach Gardens, Florida. The expiration date of Master Contract DE-AM04-03AL67577 is July 31, 2009. A competitive follow-on to the contract with WSI was awarded on December 29, 2008, with the effective date of January 5, 2009, to Innovative Technology Partnerships (ITP). On January 12, 2009, the award of the new contract was timely protested to the Government Accountability Office (GAO) requiring the immediate suspension of the award pending resolution of the protest. Corrective action was taken to address the issues raised in the GAO protest. On June 17, 2009, a new selection decision was issued. On June 22, 2009, the new selection decision was protested to the GAO, which according to the bid protest regulations gives GAO 100 days to issue a decision. On June 23, 2009, a protest was filed in the U.S. Court of Federal Claims (COFC), which does not have a definitive schedule for issuing a decision; therefore, it is necessary to include the option period. Due to the COFC protest, the GAO protest was dismissed on June 26, 2009.
