Louis Stokes ClevelandDepartment of Veterans Affairs Medical CenterVISN 10 Contracting ManagementJustification and Approval for Other than Full and Open Competition Upon the basis of the following justification, the use of other than full and open competition for the proposed contract action is hereby recommended for approval pursuant to the authority of 41 U.S.C. 253(c) (1), and FAR 6.302-1, only one responsible source. 1.Identification of Agency and Contracting Activity The Louis Stokes Cleveland VA Medical Center, 10000 Brecksville Road, Brecksville, OH 44141, VISN 10 Contracting Activity, 90C(B). 2.Nature/Description of Action This activity proposes to solicit with Sun Nuclear Corporation to provide maintenance and support for the MapCHECK software system. 3.Description of Supplies/Services The proposed procurement will provide the LSVAMC with software maintenance and support for the MapCHECK software system. The maintenance and support agreement will be for one base year plus four option years. The MapCHECK unit is a sophisticated device of a 2-D array of radiation detectors that can profile radiation doses delivered by linear accelerators. This capability is critical in treatment of cancer patients with accuracy and in compliance with standards of care guidelines. Sun Nuclear is the only vendor that manufactures the MapCHECK software package, and has proprietary data rights to the software. 6. Publicized Requirements The J&A will be posted on FBO within 14 days of the award. 7.Determination of a Fair and Reasonable Cost The contracting officer has determined the price of these items to be fair and reasonable based on previous purchases from this company. The cost of service for last year's purchase order was $5,591.00, but it was only for ten months. The quote for the base year, as well as the option years, is $8,386.00 per year. 8.Market Survey GSA was searched, and a sources sought was posted to FBO July 14, 2009. It closed July 16, 2009, with no responses. 9.Other Supporting Data None 10. Actions taken to remove barriers to competition None 11.
