Description
The Government intends to solicit and negotiate with only one source, Ultrax Inc., 4200 NE Sun Ct., Lees Summit, MO 64064-2245. The procurement will be conducted on a sole source basis in accordance with the statutory authority of the Test Program for Commercial Items, Section 4202 of the Clinger-Cohen Act of 1996 as codified at 10 USC Sec. 2304(g)(1)(B), and amended by Section 807 of the Ronald Reagan National Defense Authorization Act of 2005 under the authority of FAR 13.501(a)(1)(ii). This acquisition is for the reset and upgrade of thirteen (13) UxValidator Stab/SAS test sets (PN 05-0330-07). Reset consists of 13 new SAS2 cables, replacement/repair of any other cable, unit calibration and UxValidator reconditioning as required. Upgrade shall consist of the installation of Upgrade Kit (PN 06-0301-50). The basis for restricting competition is Ultrax is the manufacturer of the UxValidator test set and Upgrade Kit. The test sets and upgrade kit are proprietary to Ultrax. The NAICS code for this procurement is 334515 and the small business size standard is 500 employees. This sole source requirement will be procured under Other Than Full and Open Competition procedures and awarded on an unrestricted basis. THIS IS NOT A REQUEST FOR COMPETITIVE OFFERS and a solicitation will not be issued; however, any firm that believes it can meet the requirements may give written notification to the Contracting Officer not later than 2 September 2009, 2:00 pm CDT. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the requirements listed. Responses received will be evaluated; however a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. If no responses are received, the Government will proceed with the sole source negotiation with Ultrax, Inc. Award will be made in accordance with FAR Part 12, Acquisition of Commercial Items.
