This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number is: Utilities-09-04-Gas issued as a Request for Proposal (RFP). A. Requirement. Provision of natural gas supply to building 61 and building 208 at Sembach Annex. Sembach Annex is located close to the City of Kaiserslautern. A fixed price utility contract with economic price adjustment is contemplated. The contractor shall provide all labor, tools, equipment, material, personnel, supervision, management and financing, shall obtain any licenses or permits required and any other items necessary for the provision of natural gas supply to the aforementioned facilities in accordance with the technical descriptions, enclosed as Attachment 1 (building 61) and Attachment 2 (building 208), both in English and German language. The contractor shall perform the natural gas supply in accordance with commercial standards, practices and local host nation laws and regulations. Natural gas supply shall be provided F.O.B. delivery point as further described in the technical description for the supply with natural gas (see item E). USAFE will not provide logistics support. B. Place of Performance. Buildings 61 and 208, 67681 Sembach C. Anticipated Contract Type. 1. Fixed price contract with economic price adjustment for-- (a) a 1-year period; and (b) a 2-year period. 2. Fixed price contract on the basis of the actual consumption for-- (a) a 1-year period; and (b) a 2-year period. D. Start Date of Natural Gas Supply. 01 October 2009. E. See Attachment 2, Technical Description for the Supply with Natural Gas for Building 208, Sembach Annex. F. Other Information. 1. See Attachment 3, Actual load profile of the previous gas business year, 01 October 2007 through 30 September 2008 for natural gas supply to building 61, Sembach Annex. 2. See Attachment 4, Actual load profile of the previous gas business year, 01 October 2007 through 30 September 2008 for natural gas supply to building 208, Sembach Annex. 3. See Attachment 5, Actual load profile of the current gas business year, 01 October 2008 through 31 July 2009 for natural gas supply to building 61, Sembach Annex. 4. Buildings 61 and 208 at Sembach Annex are connected to the natural gas net of the Gasanstalt Kaiserslautern AG. G. Price. All data and prices shall be submitted in Euro (€) currency, separated as follows and for the periods addressed in item C above. All prices proposed shall be exclusive of any taxes and duties from which the US Government is exempt under the NATO Statute of Forces Agreement. 1. Price, comprising-- (a) Demand charge per annum per kW (b) Consumption price per kWh 2. Net usage costs (shall be considered and listed separately). 3. Offerors shall submit documentation to show satisfactory performance of a contract within the last five years of similar scope and magnitude, demonstrating their ability to perform the proposed effort, including current and correct telephone numbers, FAX number, and email addresses of Point of Contacts (POCs). Satisfactory completion means that the offeror performed the contract according to its terms and conditions without major deficiencies. Submission of documentation is not required for offerors who have been awarded a contract of similar scope and magnitude by 700 CONS within the specified period. J. Evaluation of Proposals. Depending on the efficiency, the government will award a single commercial Firm Fixed-Price contract either (i) with economic price adjustment or (ii) on the basis of actual consumption for either a 1-year period or a 2-year period resulting from this RFP to the one responsible offeror whose proposal conforming to the solicitation is lowest price with satisfactory Past Performance. A responsible offeror must demonstrate (i) adequate financial resources, (ii) compliance with the proposed performance schedule, (iii) satisfactory past performance, (iv) satisfactory record of intergrity and business ethics, and (v) must be CCR (Central Contractor Registration) registered. The requirement of Past Performance Information as indicated in paragraph I. must be met. Proposals will only be accepted in Euro currency. K. Closing Date for Receipt of Proposals. Proposals shall be submitted electronically by email or FAX no later than 11 September, 16:00 hours local time to one of the following email addresses: Gabriele.Binder@ramstein.af.mil or Uschi.Hoermann@ramstein.af.mil or FAX Number 049-631-536-8410. Late submission will be handled as follows:. 1. Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. 2. (a) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is "late" and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and- (1) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or (2) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or (3) If this solicitation is a request for proposal, it was the only proposal received. (b) However, a later modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted. 3. Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel. 4. If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume. 5. Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. As the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
