- Description
- The National Cancer Institute (NCI), Center for Cancer Research (CCR), Laboratory of Cancer Biology and Genetics (LCBG), Molecular Pathology Unit (MPU), plans to procure on a sole source basis the brand name Aperio Image Analysis Software from Aperio Technologies, Inc.; 1360 Park Center Drive; Vista, CA 92081. This acquisition will be conducted under the procedures for acquiring commercial items authorized in FAR Part 12 and under the authority FAR 13.501 to use simplified acquisition procedures for commercial items. The North American Industry Classification System code for this acquisition is 511210 and the business size standard is $25M. The Molecular Pathology Unit, of the Center for Cancer Research at the NCI, is a member of the Laboratory of Cancer Biology and Genetics. The major goal of the Laboratory of Cancer Biology and Genetics is to elucidate the complex molecular and genetic programs governing tumor initiation and metastatic progression through the development and analysis of better, more relevant genetically engineered mouse models of human cancer. The digital tissue slide, whole image automated analysis pattern recognition software will allow objective, quantitative tissue analysis of whole tissues sections across entire research studies. Software will be used with existing instrument to perform automated quantitative image analysis. Such analyses serve to enhance useable data from research specimens. PART II. Facts and Reasons To Justify Other than Full And Open Competition 1. Statute: 13.106-1 (b)(2) (b) Solicitation from a single source. (2) For Sole source acquisition of commercial items in excess of the simplified acquisition threshold conducted pursuant to subpart 13.5, the requirements at 13.501 apply. Sole Source Justification The Aperio Image Analysis Software is p roprietary and must be compatible with the NCI owned and operated Aperio ScanScope XT and the Aperio Spectrum database. Proprietary software proposed for purchase must be compatible with current instrument operating system to allow for rendering accurate, reproducible matrices. Unacceptable error is introduced into data analysis in the absence of existing system compatibility. The existing instrument manufacturer has an exclusive licensing agreement for the proposed software. This is not a solicitation for competitive quotations. However, if any interested party believes it can perform the requirement as detailed they may submit a statement of capabilities. All information furnished shall be in writing and must contain sufficient detail to allow the NCI to determine if it can meet the above unique specifications described herein. An original and one copy of the capability statement must be received in the contracting office on or before 11:00 am ET, on September 22, 2009. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
