Description
Letter of Intent to Sole Source for Siemens Medical Solutions USA, Inc. The Department of Veterans Affairs, VA Boston Healthcare System, Biomedical Engineering intends to sign Sole Source maintenance agreements with Siemens Medical Solutions USA, Inc. for the maintenance of the following CT Scanners: 1.A Siemens Primus High Energy (K-series) Bundle 2.A Siemens Magnetom Trio 3.A Siemens Somatom Sensation 64 CT Tomography scanner It is the Governments intention to solicit and negotiate only with this source. Please refer to the Sole Source Justification. This is not a solicitation; it is notice of intent to sole source a requirement. Inquires/information received after established deadline of 3pm EST on September 11, 2009 shall not be considered. The submission of any data for review shall not impede award of this contract as planned. The Government does not intend to pay for information solicited. This synopsis is issued pursuant to FAR 6.302-1. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION: 1.Transaction #s: 523-10-1-7441-007 for maintenance & support of a Siemens Somatom Sensation 64 CT Tomography scanner 523-10-1-7441-0009 for maintenance & support of a Siemens Magnetom Trio 523-10-1-7441-0017 for maintenance & support of a Siemens Primus High Energy (K-Series) Bundle 2.Identification of the agency and the contracting activity V.A MEDICAL CENTER, BOSTON, MA. (SUPPLY OFFICE) 3.Nature and/or description of the action being approved. SOLE SOURCE PROCUREMENT FOR SUPPLIES/SERVICES 4.Description of the supplies or services required meeting the agencys needs (including the estimated value). Parts and labor to maintain the Siemens equipment noted above in Section #1. This includes all upgrades to both hardware and software. Estimated value overall is $388,218.12 5Identification of the statutory authority permitting other than full and open competition. FAR PART 6.302 - ONLY ONE RESPONSIBLE SOURCE 6Demonstration that the proposed contractors unique qualifications or the nature of the acquisition requires use of the authority cited. Siemens is the sole producer of up to date products and or services for this equipment 7Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a Commerce Business Daily notice was or will be publicized as required by subpart 5.2 (copy attached) and, if not, which exception under 5.202 applies. Siemens is the manufacturer of this equipment and as such is the only source for current proprietary parts and required software. An intent to Sole Source will be published on FBO to ensure there is no one else that can provide these services, equipment and software 8Determination by the contracting officer that the anticipated cost to the government will be fair and reasonable. After careful searching of the web and other sources the contract officer requested in writing from the vendor a statement attesting that this is the standard retail price and is, in fact. 9Description of the market survey conducted (i.e., names of firms and the date(s) the firms were contacted) and the results or a statement of the reasons a market survey was not conducted. The web, and several federal sites were searched. Since this company is the manufacturer it is considerd the only source for current proprietary parts, training, software and technical advice. 10Any other facts supporting the use of other than full and open competition, such as an explanation why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available. As indicated previously in this document, Siemens is the original equipment manufacturer and is the sole supplier for equipment, software, applications, technical training and regulatory guidance. 11A listing of the sources, if any that expressed, in writing, an interest in the acquisition. Previous postings and searches have produce no other vendors interested or capable of providing this proprietary service 12A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. Since there is no other vendor capable of providing the proprietary services and equipment, a posting will be made to FBO prior to the Sole Source award. However, the Contracting department will continue to encourage full and open competition whenever possible.
