DEPARTMENT OF VETERANS AFFAIRS NETWORK 22 LOGISTICS OFFICEJUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITIONFAR 6.302-1, 41 U.S.C. 253 (c) (1)"CUTLER HAMMER BREAKERS-SWITCHGEAR BLDG 299"VA-262-09-RQ-0495 1. Agency and Contracting Activity Identification: The Network 22 Logistics Office, 5901 E. 7th Street, Long Beach, California, as requested by the VA Greater Los Angeles Healthcare System, shall enter into a contract that requires justification for other than full and open competition. 2. Nature of Acquisition Being Approved: Sole source contractor shall two (2) Cutler Hammer Breakers in support of the switchgear project in building 299 for the VA Greater Los Angeles Healthcare System patients under the terms and conditions of the contract. 3. Description of Requirement: VA Greater Los Angeles Healthcare System is requesting sole source procurement from Edison ESI, 7300 Fenwick Lane, Westminster, CA 92683-5238 to provide two Cutler Hammer Breakers. The period of performance shall be 08/28/2009 through 10/24/2009, as the manufacture time for the Breakers is 8 weeks. The estimated annual cost is $28,333.00. 4. Statutory Authority Permitting Other Than Full and Open Competition: The service being procured under the authority of 41 U.S.C. 253 (c) (1), FAR Part 6.302-1(b), Only One Responsible Source. 5. The Nature of the Acquisition Requires Use of the Authority Cited: Edison ESI is the only company that can provide these breakers. The switchgear cabinets in the B.299 substation are from an earlier era and narrower than the industry standard has been since at least the 1950s. Building 299 was built around these units and cannot be modified. Standard units cannot be used and the required clearances maintained for safe working distance. These two breakers are spares for this substation. The substation cannot be energized without the spares on hand as any failure would leave the north campus without electrical power for a significant period of time until the new breakers could be manufactured. These spare breakers will be manufactured alongside the breakers being installed in the substation so that no additional set up cost for manufacturing would be incurred but more importantly electrical power could be restored immediately to the clinical programs on the north campus. There are at this writing 842 in patients on the north campus, many thousands of outpatients and a large Research Facility all of which would be threatened by the inability to restore power in an emergency. 6. A Description of Efforts Made to Ensure That Offers From as Many Potential Sources As Practicable and Whether a Notice Will Be Publicized. See number 5 above. A Presolcitation Notice were transmitted to the GPE (Fedbizzopps). 7. Anticipated Cost: The anticipated cost is fair and reasonable to the government based on market research conducted on the internet. 8. Results of Market Survey: Market research information was also obtained by other contractors. See Items 5 above. 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition: None. See Items 5 above. 10. Any Other Interested Sources There are no other sources that expressed in writing an interest in the service other than the incumbent who cannot perform the requirements. See Item 5. 11. A Statement of the Actions, if any, the Agency May Take To Remove of Overcome Any Barriers to Competition Before Any Subsequent Acquisition is required: None.
