- This contract action was not awarded as a fixed price type because it was not possible to estimate accurately the extent or duration of the work or to anticipate costs with any reasonable degree of confidence. As such, a labor-hours type action was awarded for non-commercial services (FAR 16.602). This contract action was accomplished using other than competitive procedures because this is an order under an existing contract that was awarded using non-competitive procedures. RECOVERY - PER FAR 5.7 THIS NOTICE IS PROVIDED FOR INFORMATION PURPOSES ONLY: THEREFORE FAR 5.203 DOES NOT APPLY. THIS OPPORTUNITY WAS AVAILABLE ONLY TO CONTRACTOR UNDER THE CURRENT CONTRACT NUMBER: Palmer Soil & Water Consrvation District, W912CZ-09-D-0017, Land Restoration and Rehabilitation Maintenance - Repair Fire Tower Ridge Trails. This contract action was accomplished using other than competitive procedures because this is an order under an existing contract that was awarded using non-competitive procedures by Authority in Title 10 USC 2304(c)(5) or FAR Pt 6.302-5 Authorized as required by statute. The Sikes Improvement Act (2003) cited that priority should be given to the entering of contracts for the procurement of such implementation and enforcement services with Federal and State agencies having responsibility for conservation and management of fish or wildlife. In other words, if an installation cannot retain in-house, governmental personnel to do natural resources conservation work, then other Federal and State natural resources agencies have, by this law, a right of first refusal to accept this work on a reimbursable basis. The Sikes Act Committee Report defined natural resources as inherently governmental. Furthermore, the Sikes Act says neither Office of Management and Budget Circular A-76 nor any successor circular thereto applies to the procurement of services that are necessary for that implementation and enforcement. This is the portion of the Sikes Act that expressly prohibits the use of OMB Cir. A-76 to contract for services to implement or enforce INRMP. Compliance with these regulations requires stewardship of the natural resources and training facilities on military installations and application of the data in management decisions. USAG-AK needs assistance to carry out the considerable obligations set forth in the INRMP. When natural resource management assistance is needed to carry out INRMP obligations, federal law (16 USC Part 670a) and Army Regulation (AR 200-1 Environmental Protection and Enhancement dated 13 Dec 2007) require an installation to obtain necessary assistance from those federal and state natural resource management agencies having the necessary expertise. Palmer Soil & Water Conservation District is the agency from the State of Alaska to perform conservation planning and implementing conservation practices at the Fort Richardson site.
