This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued I. INTRODUCTION A. Agency Information - The U. S. Railroad Retirement Board (RRB) is an independent Federal agency that administers a retirement and survivor benefits program for railroad employees and their families. The RRB was established by the Railroad Retirement Acts of 1937 and 1974. The RRB headquarters is located in Chicago, Illinois. B. The RRB is seeking the services of a contractor to provide labor,supervision, materials, equipment and all associated accessories for preparing surfaces, wall modification and construction, electrical rewiring, sprinkler and HVAC modifications for the construction of new offices on the 3rd floor of the RRB as specified in Section III of this solicitation. III. Statement of Work A. Description of services The Contractor shall provide labor, supervision, materials, equipment and all associated accessories for preparing surfaces, wall modification and construction, electrical rewiring and HVAC, and sprinkler modifications, new acoustical ceiling panels for the construction of new offices on the 3rd floor of the RRB. All work for this project must meet the requirements of the attached drawings (Attachments A, B and C) and the requirements and specifications listed in Section III, Statement of Work. B. Hours of Performance 1. Work will be performed after normal working hours i.e. 6:30PM - 6:00AM or on weekends unless otherwise arranged and/or directed with the Contracting Officer (CO) or Contracting Officer's Technical Representative (COTR). 2. If you have any questions please contact the RRB Facility Manager, Mr. Scott Rush at (312) 751-4566 or scott.rush@rrb.gov 3. The RRB Facility Manager will be conducting a site visit on 9/16/09 at 9:30AM. If an offeror is unable to attend the site visit please contact the Facility Manger to schedule a different time for the site visit. C. Special Instructions for Contractors: 1. Maintain access to existing walkways, exits, and other facilities used by occupants during working hours and after hours to the maximum extent possible. 2. Work areas immediately adjacent to work area are occupied. Conduct work so operations of occupied areas will not be disrupted. 3. Protect existing carpeted surfaces so as to not damage existing carpeted flooring material or ceilings. 4. Contractor will be responsible for replacing any ceiling tile damaged during the construction.5. Any walls, floors ceilings etc. that are altered or damaged during construction will be repaired to existing pre-damage conditions. D. Contractor Qualifications and Submissions 1. The Contractor shall provide skilled and properly trained personnel in this trade for each and every phase of work performed. 2. The Contractor shall submit documentation listed below in their Technical Proposal as follows: a. Provide HVAC plan showing revised ductwork layout indicating additional diffusers and grilles. b. Revised sprinkler layout c. Revised electrical wiring diagrams. d. Reflected ceiling plan for new offices showing revised sprinkler and lighting locations.E. Supplies, Materials and Equipment 1. Government Furnished Material: a. New 2'x4' light fixtures as needed. 2. Contractor Furnished Material:a. The Contractor shall provide supplies, materials, equipment and all associated accessories to furnish a complete installation in accordance with applicable codes.b. All materials required for proper surface preparation and patching, included but not limited to, wall construction, sound attenuation blanket, electrical wiring, HVAC and sprinkler modifications.c. Doors, door frames, and door hardware as well as cylindrical locksets.d. New acoustical ceiling pads to match existing. (Armstrong #895 fissured fire guard, 2' x 4')e. Sound attenuation blanketF. Execution 1. Conduct pre-construction conference at site to coordinate work. Assume that work will not begin until all existing systems furniture is removed from the area by others. 2. Provide demolition of walls as shown on attached drawings and installation of new walls as indicated. Install new 3'-0"x 7'-0" metal doors and new hollow metal frames into existing and new offices. Reuse existing doors and frames if possible. Provide new cylindrical locksets w/ levered handle, brush aluminum finish, with new stainless steel hinges for office doors, provide new floor bumpers.3. Construct new walls floor to ceiling as shown on attached drawings. All new walls to be insulated with new sound attenuation blanket.4. Provide all electrical rough-in including relocation of existing ceiling lights that interferes with new wall layout. Relocate and/add lighting as needed to provide adequate lighting for new layout.5. Provide new outlets and switches as shown on attached drawings. Revise existing lighting circuits as necessary to properly switch new room construction.6. Identify and label all circuits in existing electrical panels.7. Install new metal doors, hardware, and hollow metal frames as shown on attached drawings. Provide floor or wall bumpers as needed.8. Patch all surfaces as needed and prepare all surfaces for work/painting to be performed under another contract.9. Provide adequate ventilation to accommodate new room configuration. Must meet ASHRAE standards for IAQ and air changes (20CFM/person). (Field investigation will be required in order to provide HVAC plan showing revised ductwork layout indicating additional diffusers and grilles).11. Modify existing sprinkler system heads per attached drawing.12. All work shall be per manufacturer's recommendations and instructions.13. All work for this project must meet the requirements of the NEC, NFPA, and all applicable codes.14. Remove and replace all acoustical ceiling panels. Modify ceiling grid as needed.G. Workmanship1. All work shall be coordinated and scheduled with the COTR Mr. Scott Rush, 312-751-4566 or scott.rush@rrb.gov2. The CO or COTR has the right to reject any unsatisfactory or unsuitable material or workmanship.3. All work shall be accomplished in accordance with the best practices of the trades.H. Debris Removal 1. All debris generated in the performance of this contract shall be removed daily by the Contractor. Debris shall be removed offsite by the Contractor at the Contractor's expense. 2. Owner assumes no responsibility for buildings, structures, items to be demolished.3. It is not expected that hazardous materials will be encountered in the work. If materials suspected of containing hazardous materials are encountered, do not disturb, immediately notify Owner. Hazardous materials will be removed by Owner under a separate contract.I. Contractor Compliance and Responsibility 1. The Work, including contact with or handling of hazardous materials, disturbance or dismantling of structures containing hazardous materials, and disposal of hazardous materials, shall comply with the applicable requirements of 29 CFR Parts 1910 and 1926, and 40 CFR Parts 61, 261, 761 and 763.2. The Contractor shall assume full responsibility and liability for compliance with all applicable codes, standards, and regulations pertaining to the health and safety of personnel during execution of the work, and shall hold the government harmless for any action on the Contractor's part, or that of the Contractor's employees or subcontractors, that result in illness, injury, or death. 3. The Contractor shall provide for appropriate emergency first aid materials and equipment. In addition, the contractor must provide the following on site: a twenty pound ABC-rated fire extinguisher.J. Products 1. PERSONAL PROTECTIVE EQUIPMENT Special facilities, devices, equipment, and similar items used by the Contractor in execution of the Work shall comply with 29 CFR Part 1910, Subpart I and other applicable regulations. 2. HAZARDOUS MATERIALS a. The Contractor shall bring to the attention of the Contracting Officer, or the Contracting Officer's authorized representative, any material encountered during execution of the work that the Contractor suspects is hazardous. b. The Contracting Officer shall determine whether the Contractor shall perform tests to determine if the material is hazardous.K. Protection of Personnel1. The Contract shall take all necessary precautions to prevent injury to the public, occupants, or damage to property of others. The public and occupants includes all persons not employed by the Contractor or a subcontractor.2. Where practical, the work area shall be fenced, barricaded, or otherwise blocked off from the public or occupants to prevent unauthorized entry into the work area.a. Provide traffic barricades and traffic control signage where construction activities occur in vehicular areas.b. Corridors, aisles, stairways, doors, and exits shall not be obstructed or used in a manner to encroach upon routes of ingress or egress utilized by the public or occupants, or to present an unsafe or unhealthy condition to the public or occupants.c. Store, position, and use equipment, tools, materials, scraps, and trash in a manner that does not present a hazard to the public or occupants by accidental shiftings, ignition, or other hazardous activity.d. Store and transport refuse and debris in a manner to prevent unsafe and unhealthy conditions for the public and occupants.e. Cover refuse containers, and remove refuse on a frequent regular basis acceptable to the Contracting Officer. Use tarpaulins or other means to prevent loose transported materials from dropping from trucks.L. Environmental Protection1. Dispose of solid, liquid and gaseous contaminants in accordance with local codes, laws, ordinances, and regulations.2. Comply with applicable federal, state and local noise control laws, ordinances and regulations, including but not limited to 29 CFR 1910.95 and 29 CFR 1926.52.M. Guarantees1. The Contractor shall guarantee all work, material, equipment and labor for one year.2. All work shall be free from defective or inferior materials,3. Contractor shall provide technical assistance/ guidance during the warranty periodIV. CLAUSESA. Davis-Bacon Act (Jul 2005) FAR 52.222-6(1) Definition.-"Site of the work"(a) Means--(1) The primary site of the work. The physical place or places where the construction called for in the contract will remain when work on it is completed; and (2) The secondary site of the work, if any. Any other site where a significant portion of the building or work is constructed, provided that such site is- (a) Located in the United States; and (b) Established specifically for the performance of the contract or project; (b) Except as provided in paragraph (c) of this definition, includes any fabrication plants, mobile factories, batch plants, borrow pits, job headquarters, tool yards, etc., provided-(1) They are dedicated exclusively, or nearly so, to performance of the contract or project; and(2) They are adjacent or virtually adjacent to the "primary site of the work" as defined in paragraph (1) (a)(1), or the "secondary site of the work" as defined in paragraph (1)(a)(1) of this definition;(c) Does not include permanent home offices, branch plant establishments, fabrication plants, or tool yards of a Contractor or subcontractor whose locations and continuance in operation are determined wholly without regard to a particular Federal contract or project. In addition, fabrication plants, batch plants, borrow pits, job headquarters, yards, etc., of a commercial or material supplier which are established by a supplier of materials for the project before opening of bids and not on the Project site, are not included in the "site of the work." Such permanent, previously established facilities are not a part of the "site of the work" even if the operations for a period of time may be dedicated exclusively or nearly so, to the performance of a contract.(2)(a) All laborers and mechanics employed or working upon the site of the work will be paid unconditionally and not less often than once a week, and without subsequent deduction or rebate on any account (except such payroll deductions as are permitted by regulationsissued by the Secretary of Labor under the Copeland Act (29 CFR Part 3)), the full amount of wages and bona fide fringe benefits (or cash equivalents thereof) due at time of payment computed at rates not less than those contained in the wage determination of the Secretary of Labor which is attached hereto and made a part hereof, or as may be incorporated for a secondary site of the work, regardless of any contractual relationship which may be alleged to exist between the Contractor and such laborers and mechanics. Any wage determination incorporated for a secondary site of the work shall be effective from the first day on which work under the contract was performed at that site and shall be incorporated without any adjustment in contract price or estimated cost. Laborers employed by the construction Contractor or construction subcontractor that are transporting portions of the building or work between the secondary site of the work and the primary site of the work shall be paid in accordance with the wage determination applicable to the primary site of the work.(b) Contributions made or costs reasonably anticipated for bona fide fringe benefits under section 1(b)(2) of the Davis-Bacon Act on behalf of laborers or mechanics are considered wages paid to such laborers or mechanics, subject to the provisions of paragraph (5) of this clause; also, regular contributions made or costs incurred for more than a weekly period (but not less often than quarterly) under plans, funds, or programs which cover the particular weekly period, are deemed to be constructively made or incurred during such period.(c) Such laborers and mechanics shall be paid not less than the appropriate wage rate and fringe benefits in the wage determination for the classification of work actually performed, without regard to skill, except as provided in the clause entitled Apprentices and Trainees. Laborers or mechanics performing work in more than one classification may be compensated at the rate specified for each classification for the time actually worked therein; provided, that the employer's payroll records accurately set forth the time spent in each classification in which work is performed.(d) The wage determination (including any additional classifications and wage rates conformed under paragraph (3) of this clause) and the Davis-Bacon poster (WH-1321) shall be posted at all times by the Contractor and its subcontractors at the site of the work in a prominent and accessible place where it can be easily seen by the workers.(3)(a) The Contracting Officer shall require that any class of laborers or mechanics which is not listed in the wage determination and which is to be employed under the contract shall be classified in conformance with the wage determination. The Contracting Officer shall approve an additional classification and wage rate and fringe benefits therefore only when all the following criteria have been met:(1) The work to be performed by the classification requested is not performed by a classification in the wage determination.(2) The classification is utilized in the area by the construction industry.(3) The proposed wage rate, including any bona fide fringe benefits, bears a reasonable relationship to the wage rates contained in the wage determination.(b) If the Contractor and the laborers and mechanics to be employed in the classification (if known), or their representatives, and the Contracting Officer agree on the classification and wage rate (including the amount designated for fringe benefits, where appropriate), a report of the action taken shall be sent by the Contracting Officer to the Administrator of the:Wage and Hour DivisionEmployment Standards Administration U.S. Department of Labor Washington, DC 20210 The Administrator or an authorized representative will approve, modify, or disapprove every additional classification action within 30 days of receipt and so advise the Contracting Officer or will notify the Contracting Officer within the 30-day period that additional time is necessary.(c) In the event the Contractor, the laborers or mechanics to be employed in the classification, or their representatives, and the Contracting Officer do not agree on the proposed classification and wage rate (including the amount designated for fringe benefits, where appropriate), the Contracting Officer shall refer the questions, including the views of all interested parties and the recommendation of the Contracting Officer, to the Administrator of the Wage and Hour Division for determination. The Administrator, or an authorized representative, will issue a determination within 30 days of receipt and so advise the Contracting Officer or will notify the Contracting Officer within the 30-day period that additional time is necessary.(d)The wage rate (including fringe benefits, where appropriate) determined pursuant to subparagraphs (3)(b) and (3)(c) of this clause shall be paid to all workers performing work in the classification under this contract from the first day on which work is performed in the classification.(4) Whenever the minimum wage rate prescribed in the contract for a class of laborers or mechanics includes a fringe benefit which is not expressed as an hourly rate, the Contractor shall either pay the benefit as stated in the wage determination or shall pay another bona fide fringe benefit or an hourly cash equivalent thereof.(5) If the Contractor does not make payments to a trustee or other third person, the Contractor may consider as part of the wages of any laborer or mechanic the amount of any costs reasonably anticipated in providing bona fide fringe benefits under a plan or program; provided, That the Secretary of Labor has found, upon the written request of the Contractor, that the applicable standards of the Davis-Bacon Act have been met. The Secretary of Labor may require the Contractor to set aside in a separate account assets for the meeting of obligations under the plan or program.B. Wage Determination Offerors are advised that the various classes of service employees who will be employed in the performance of the contract awarded under this Request for Proposals must be paid the minimum monetary wage and shall be furnished fringe benefits per the Davis Bacon Act Wage Determination, General Decision Number IL20070009 (see Attachment D)C. Technical Direction 1. Performance of the work under this contract shall be subject to the technical direction of the Contracting Officer Technical Representative (COTR). The term "technical direction" is defined to comprise the following:a. Directions to the contractor which redirect the contract effort, shift work emphasis between work areas or tasks, require pursuit of certain lines of inquiry, fill in details or otherwise serve to accomplish the contractual statement of work.b. Provisions of information to the contractor which assists in the interpretation of drawings, specifications or technical portions of the work description.c. Review and, where required by the contract, approve technical reports, drawings, specifications and technical information to be delivered by the Contractor to the Government under this contract.2. Technical directions must be within the general scope of work stated in the contract. The Technical Manager does not have the authority toand may not issue any direction which (a) constitutes an assignment of additional work outside the general scope of the contract; (b)constitutes a change as defined in the contract article entitled "Changes"; (c) in any manner causes an increase or decrease in the estimated cost or the time required for contract performance; or (d) changes any of the expressed terms, conditions, or specifications of the contract.3. The Contractor shall proceed promptly with the performance of technical directions duly issued by the COTR in the manner prescribed by this section and within his authority under the provisions of this section. If, in the opinion of the Contractor, any instruction or directions issued by the COTR is within one of the categories as defined in 2(a) through (d) above, the Contractor shall not proceed but shall notify the Contracting Officer within five (5) working days after receipt of any such instruction or direction and shall request the Contracting Officer to modify the contract accordingly. Upon receiving such notification from the Contractor, the Contracting Officer shall issue an appropriate contract modification or advise the Contractor in writing that, in his opinion, the technical direction is within the scope of this section and does not constitute a change under the Changes article of the contract. The Contractor shall thereupon proceed immediately with the direction given. A failure of the parties to agree upon the nature of the instruction or direction or upon the contract action to be taken with respect thereto shall be subject to the provisions of the contract article entitled "Disputes".D. Contracting Officer: The Contracting Officer has the overall responsibility for the administration of this contract. He alone, without delegation, is authorized to take actions on behalf of the Government to: amend, modify or deviate from the contract terms, conditions, requirements, specifications, details and/or delivery schedules; make final decisions on disputed deductions from contract payments for nonperformance or unsatisfactory performance; terminate the contract for convenience or default; issue final decisions regarding contract questions or matters under dispute. He may, however, delegate certain other responsibilities to his authorized representatives including the COTR and the Contractor Administrator. E. The Contractor shall submit the invoice and supporting documents to the CS. The CS and COTR shall certify services received by the RRB. C. SPECIAL INSTRUCTIONS Privacy and Security: Prior to beginning work on this project with the RRB, the Contractor shall supply the RRB with a list of the names of all employees who will be working onsite at the RRB to accomplish this project. When the contractor employees arrive at the RRB they must present a valid photo ID to the RRB security guard on duty. VI. SUBMISSION OF QUOTATIONS/PROPOSALS A. Offers are due by 12:00 PM Central Standard Time (CST) on Wednesday, September 23, 2009. Proposals/Quotes can be submitted by e-mail to proposals@rrb.gov. Questions regarding this solicitation can also be submitted by e-mail to the address above by Thursday, September 17th at 4:30PM. B. Offerors should be submitted in two volumes: a Technical and Business Proposal.1. The Technical Proposal in two copies should consist of the following:a. Detailed narrative description of how the offeror will perform the task, steps and activities described in Section III to complete the construction of offices on the third floor at the RRB.b. A projected time schedule for accomplishing the work required by the RRB as explained by the offeror's plan (above) to meet the RRB's required and/or desired timeframe.c. The Contractor shall submit documentation listed below in their Technical Proposal as follows:1. Supply Air diffusers and grilles. (catalog cutsheets)2.
