- JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION (OVERSEAS CONTRACTING ACTIVITIES) 1.I recommend that Embassy Beijing, China use other than full and open competition for the acquisition of an out-of-scope extension to the Health and Life Insurance contract for Locally Engaged Staff (LES). The estimated cost for a four month extension is $152,446.00. 2.Nature and/or description of the action being approved. The current contract for LES Health and Life Insurance will expire on September 30, 2009. This four month out-of-scope extension modification to the existing contract is necessary and will ensure there is no break in coverage while the Government continues with a new competitive solicitation. 3.A description of the supplies or services required to meet the agency’s needs. This four month out-of-scope extension modification to the existing contract will ensure there is no break in medical and life insurance coverage for LES employees in US Embassy Beijing, US Consulate General Shenyang, US Consulate General Shanghai, US Consulate General Guangzhou, and US Consulate General Chengdu. 4.An identification of the statutory authority permitting other than full and open competition. 41 USC 253(c)(2), FAR 6.302-2, Unusual and Compelling Urgency 5.A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited (for sole source acquisitions; also required for unusual and compelling urgency where more than one offer will not be solicited). The incumbent contractor is the only source capable of providing these critical services in the short term and without a break in coverage. Although the Embassy did issue a new competitive solicitation, the solicitation had to be cancelled due to unexpected changes in the requirements and benefits level. Post is in the process of issuing a new solicitation with the period of performance to begin on February 1, 2010. Therefore, this extension will allow the Government additional time necessary to conduct this critical competition and without compromising the welfare of its local employees. 6.A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. Due to the unusual and compelling urgency of this contract extension, no advertisement or public notification was done. However, the new competitive solicitation will be advertised locally and the four firms who were provided a copy of the cancelled competitive solicitation will be provided a copy of the new solicitation. In addition, the Contracting Officer will publish this completed and signed J&A in the FedBizOps once the extension modification is issued. 7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. The Contracting Officer believes that the anticipated costs for this extension will be fair and reasonable and will conduct an in-depth price analysis to demonstrate they are. 8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted. The type of market research performed and the results of that research should be described in the justification for other than full and open competition. Embassy Human Resources Office has conducted the benefit research with embassy comparators for the new competitive solicitation. 9. Any other facts supporting the use of other than full and open competition. None 10. A listing of sources, if any that expressed, in writing, an interest in the acquisition. None for this out-of-scope extension but four companies who were provided a copy of the cancelled solicitation will be provided a copy of the new solicitation. 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. This extension is considered short term in nature. Consequently, the CO has taken the necessary steps to ensure the new solicitation will be conducting under full and open competition procedures.
