Department of Veterans Affairs Memorandum Date: September 14, 2009 From: Richard M Stockton, VISN 18 Contracting Officer Subj: Justification and Approval for Other Than Full and Open Competition IAW FAR 6.302-1 To: Contract File 1. IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY: Department of Veterans Affairs, VISN 18, PVAHCS, 650 E Indian School Road, Phoenix AZ 85012 2. IDENTIFICATION AND DESCRIPTION OF ACTION BEING APPROVED: This action is based on a requirement for the acquisition of KCI ATMOSAIR APOD25 MRS with S.A.T. at the PVAHCS. This solicitation is being procured in accordance with the Federal Acquisition Regulation (FAR) Part 12 and SubPart 13.5. It is being sole sourced to KCI USA Inc. in accordance with FAR 6.302-1. 3. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED: KCI ATMOSAIR APOD25 MRS with SAT has 25 self adjusting air pods, with cut off valves. Air is allowed out, but is regulated for consistent pressure distribution. Cut off valves keeps the pods from deflating. The foam is impregnated with an antimicrobial substance. The foot section slopes to reduce pressure, is made of tempurpedic foam with diamond cutouts in the foam layer to further reduce pressure, 500 lbs weigh limit. Non electrical powered. Power loss protection gives uninterrupted pressure relief. 5 year non prorated warranty. The estimated value of the contract is $166,571.64 based on the IGE from the program office. 4. IDENTIFICATION OF STATUTORY AUTHORITY: The requirement will be solicited under citation, 41 U.S.C 253 (c) (1), FAR 6.302-1: Only one responsible source exists and no other supplies or services will satisfy agency requirements. 5. DEMONSTRATION THAT THE ACQUISITION REQUIRES USE OF AUTHORITY CITED: In accordance with FAR 6.302-1(a) these items are unique to this vendor as no other source for this product is available and this manufactured item contains components manufactured by KCI USA which are considered proprietary. It is our professional and technical opinion that only KCI USA can provide the required item to meet the unique specifications of the PHVAHCS. 6. DESCRIPTION OF EFFORTS MADE TO ENSURE OFFERS ARE SOLICITED FROM AS MANY SOURCES AS IS PRACTICABLE: Considerable market research was done on GSA and VA advantage as well as open source research to identify other vendors or products that would meet the customer's needs. Per the market research documentation contained within the contract file, no other vendor can provide the unique characteristics for this upgraded. Special Notice was posted to FBO with the unique components of the AIRPOD25 MRS. No source responses were received which could provide the item to be acquired. One manufacture did submit a proposal for a different product. This product was review by the technical personnel and it was determined the product did not meet the technical requirements. 7. DEMONSTRATION THAT THE ANTICIPATED COST WILL BE FAIR AND REASONABLE: The price quote provided by the contractor will be compared with any previous pricing and other similar items to determine that the price is fair and reasonable. 8. DESCRIPTION OF MARKET RESEARCH Market research was extensively conducted via internet, CCR, VETBIZ, and SBA DSBS. Quality of care, reduction of incidence of pressure ulcers in Veterans is the driver for the sole source determination as well as the weight limit and non power capability. There are sources which do provide elements of the driver however none at this time provide the combination of proprietary technical specifications which has proven verifiably to reduce the incidence of pressure ulcers as significantly and to the extent as the Atmosair APOD25 MRS. Per the market research documentation memo also contained within this contracting file, no other vendor(s) were able to meet the unique characteristics. 9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION. This vendor is the only vendor capable of manufacturing and providing the product containing the proprietary product specifications. 10. LIST OF SOURCES THAT EXPRESSED IN WRITING AN INTEREST IN THE ACQUISITION. a.Hill-Rohm 11. STATEMENT OF ACTIONS AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION. The Agency will continue to evaluate the marketplace to determine if other vendors have become qualified or capable of providing this type of complex medical equipment. 12.
