- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION I. CONTRACTING ACTIVITY 448 Supply Chain Management Wing 448 SCMG/PK 3001 Staff Drive/1AG198C Tinker AFB, OK 73145 PR# FD2030-09-81019 II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED This Justification and Approval (J&A) authorizes the use of other than full and open competition procedures to obtain a firm fixed price, sole source contract with Parker Hannifin Corporation, (hereinafter, "Parker Hannifin") for procurement of upgraded pump installation kits to support the system program directive (SPD) time compliance technical order (TCTO) for the B-52H aircraft fleet (79 aircraft @ 6 each per aircraft + 59 spare engines for a total of 533 each installation kits). III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS New Manufacture of: NSN: 4320-01-564-1573HS P/N: 53066 NOUN: Installation Kits, Upgraded Pump APPLICATION: B-52H Aircraft APPROPRIATION: 3010 Estimated Delivery Schedule: 40 EA Monthly beginning 30 April 2010 Maximum Buy Quantity: 533 each Item dimensions: 10.10 in. long X 8.00 in. wide X 8.50 in. high; Weight: 18.0 lbs. Material Content: Steel and Aluminum Item description and function: This installation kit consists of a quick adapter device (QAD) and upgraded pump. The QAD is used to disconnect and mount the upgraded pump to the aircraft. This installation kit is required in order for the depot and field level maintenance to comply with the SPD TCTO to retro-fit the entire B-52H fleet with the new upgraded pump. IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION 10 U.S.C. 2304 (c) (1), as implemented by FAR 6.302-1 (a) (2) (ii), with an application pursuant to FAR 6.302-1 (b) (2). V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) The parts included in the B-52H installation kit are proprietary to Parker Hannifin, the original equipment manufacturer (OEM). The OEM is the only source that can currently satisfy the Governments requirement. The data needed to acquire this part is not physically available and is proprietary to the OEM. It cannot be obtained economically, nor is it possible to get draft specifications. Parker Hannifin is the only responsible source with the necessary design, manufacturing, production, and process data cable of providing items that meet the minimum requirements pertaining to form, fit, and function. Further, as this is a one-time buy, and this kit will not be purchased by the Air Force in the future, attempting to obtain rights to this item is not in the best interest of the Government. VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE In accordance with FAR 12.603, this requirement shall be synopsized and solicited concurrently, and the combined synopsis/solicitation posted to Federal Business Opportunities (www.FBO.gov). Due to the proprietary data involved, it is unlikely that additional potential sources will be identified as a result of this action. Parker is the only known source capable of providing the required kits. Also, as this is a one-time buy and this kit will not be purchased by the Air Force in the future, further attempts to obtain rights to this item are not in the best interest of the Government. Qualification requirements (QRs) do not apply to this procurement. VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE The contracting officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. As this is a FAR Part 12 procurement, and certified cost and pricing data is not required, "other than" Certified Cost and pricing data will be requested from the contractor if necessary. A detailed cost analysis will be performed on this data. A technical evaluation from the Defense Contract Management Agency (DCMA) and a field audit from the Defense Contract Audit Agency (DCAA) will be requested to aid in the evaluation of the contractor's proposal, followed by subsequent negotiations by the contracting activity. VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED This item has been determined by the Contracting Officer to be "Of a type" of item available in the commercial market per the Commercial Determination in the contract file. Market research has revealed that Parker Hannifin is the only manufacturer of this Upgrade Kit. At this point, there appears to be no potential for competing this item in the future.. IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION None. X. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED None, this is a "One Time Requirement" to install upgraded pumps on the B-52H fleet. Once this pump installation has been accomplished, the upgraded pump by itself (NSN 4320-01-564-1570HS) will be AMC/AMSC screened and purchased. This upgraded pump installation kit will no longer be procured. XII. CONTRACTING OFFICER'S CERTIFICATION The contracting officer's signature on the COORDINATION AND APPROVAL DOCUMENT evidences that he has determined this document to be both accurate and complete to the best of his knowledge and belief. XIII. TECHNICAL/REQUIREMENTS PERSONNEL'S CERTIFICATION As evidenced by their signatures on the COORDINATION AND APPROVAL DOCUMENT, the technical and/or requirements personnel have certified that any supporting data contained herein which is their responsibility is both accurate and complete.
