Description
(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This procurement is being issued in accordance with the procedures in FAR Part 12, Commercial Items. This announcement constitutes the only solicitation; proposals are being requested and a written synopsis will not be issued. (ii) The solicitation number is HSCG23-09-R-MSA068 and it is being issued as a Request for Proposals (RFP). (iii) The solicitation document, and the incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-34. (iv) The North American Industrial Classification System (NAICS) for this procurement is 332994 (Small Arms Manufacturing). (v) Offerors shall provide prices for the Contract item, and quantities as listed. (vi) The DHS - United States Coast Guard, Office of Contract Operations intends to award a sole source award to Remington Arms Company, Inc., 870 Remington Drive, Madison NC for an estimated 200 Remington 870 Police Shotguns 12/14P RC-FR BSTTRIJ SFIV-S SYN M2 version with Parkerized finish, fully rifled choke, Tritium Trijicon Sight, Speedfeed full piston grip – solid-13”LOP stock, synthetic-black fore-end, Michaels 1” Mountaineer (QD Swivels) sling, Saddle style scope mount; Remington is the sole manufacturer and distributor of the 870 POL 12/14P shotgun. (vii) REQUIRED DELIVERY SCHEDULE: The shotguns are required to be delivered within 90 days of the order being placed. (viii) The delivery location for the shotguns is: CWO Mike Lechler, USCG Small Arms Repair Facility, 300 HWY 361, BLDG 2561, Crane, IN 47522-5001. It is preferred that delivery price(s) be quoted (F.O.B. Destination) (ix) The provision at 52.212-1, Instructions to Offerors – Commercial, applies to this acquisition. (x) The provision at 52.212-2, Evaluation – Commercial Items applies to this acquisition. “Additional Applicable FAR and HSAR Provisions and Clauses”, for the specific evaluation criteria. (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Technical Capability will be more important than Price. (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (xi) Offeror is advised to include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications – Commercial Items with their offer; OR verify that information required by this provision is listed on the Online Representations and Certifications Application (ORCA) website located at https://orca.bpn.gov. (xii) The clause at 52.212-4, Contract Terms and Conditions – Commercial Items, applies to this acquisition. (xiii) The clause at 52.212-5, Contract Terms and Conditions Required to Implement Statues or Executive Orders – Commercial Items, applies to this acquisition. Offerors will refer to clause 52.212-5 listed for the additional clauses applicable to this acquisition. (End of clause) (xiv) Additional contract requirements and terms and conditions determined by the Contracting Officer to be necessary for this acquisition and consistent with customary commercial practices. a.WARRANTY TERMS and CONDITIONS: The Contractor shall provide Warranty on all shotguns ordered in accordance with the terms and conditions of their standard commercial warranty offerings. (xv) The Defense Priorities and Allocations System (DPAS) does NOT apply to this acquisition. (xvi) Proposals shall be submitted via “EMAIL” on or before 04:00pm EDT on 29 September 2009. JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION (1)It is recommended that DHS- United States Coast Guard use other than full and open competition for the acquisition of Remington 870 Police Shotguns from Remington Arms Company, Inc., 870 Remington Drive, Madison North Carolina. (2) The USCG Assistant Commandant for Specialized Capabilities (CG-721) has a requirement for procurement of 200 Remington Model 870 Shotguns. The Remington M870 is the current standardized shotgun in the U.S. Coast Guard and it is the only shotgun authorized for use by Coast Guard units. This weapon is only available from Remington Arms Company, Incorporated, located at 870 Remington Drive, PO Box 700, Madison, North Carolina, 27025. (3) The Remington Model 870 Shotgun is the Coast Guard standardized shotgun for Coast Guard issue, training, and use in accordance with Commandant Instruction number COMDINST M8000.2D. The procurement of this standardized firearm will provide for continuity of training, maintenance, and ammunition for shotguns in the Coast Guard.(4) The statutory authority permitting other than full and open competition is 10 USC 2304(c)(1), as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”. (5) The Remington Model 870 Shotgun is the Coast Guard standardized shotgun for Coast Guard issue, training, and use in accordance with Commandant Instruction number COMDINST M8000.2D, and there are currently over 3,000 of these model shotguns in the Coast Guard inventory. This shotgun is currently the only model authorized by CG-721 for Coast Guard law enforcement missions and Use of Force situations. In addition, the Remington Model 870 Shotgun is supported by the Department of Defense(DoD) and U.S. Navy 3M MILSPEC system that provides guidelines for the operation, storage, ammunition type classification, weapon maintenance and care of all DoD purchased and approved weapons. Approval of this weapon by the DoD also means that the weapons and ammunition can be stored in DoD armories as needed. Designated as the standard shotgun for the Coast Guard, the service has instituted standardized training and safety procedures and the use of any other brand of shotgun would require an unacceptable increase in support costs for these different model weapons. (6) A Combined Synopsis/Solicitation as well as a copy of this JOTFOC will be posted on FedBizOpps as required by FAR 5.102(a) (6), 5.2, and 12.603 – “Streamlined solicitation for commercial items.”
