Description
This sole source notice is provided as required by FAR 5.201(b)(1)(ii). This contract action is a modification to an existing contract for additional services. This sole source determination has been prepared to document the facts and rationale to support the determination that only one source is available to provide the agency's requirement. The supporting data has been prepared by the Bureau of Reclamation technical personnel. 1. Description of the supplies or services: This sole source determination is for a modification to contract 09PG810169 with Glowball Solutions. The purpose of the contract is to develop major improvements to The Bureau of Reclamation Proposal and Performance Contract Management System (PropC) is a web-based application implemented by the Research and Development Office. 2. Identify the proposed contractor and describe why they are the only source capable of providing the supply/service: Glowball Solutions has been the primary architect of improvements to the PropC system and is uniquely qualified to complete these improvements and provide technical support. Furthermore, failure to continue to acquire these services from Glowball Solutions will result in a substantial duplication of cost to the government as any other contractor will require substantial lead time to become familiar with the PropC system data, programming code, and architecture. 3. Estimated cost: The Research and Development (R&D) Office is requesting an additional four months of funding be obligated to close out the existing contract in an orderly fashion. During this time the R&D Office will work with the Acquisitions Office to issue another contract for the continued development and technical support of the PropC. The additional time will allow for in progress work to continue uninterrupted. 4. Additional facts that support the sole source vendor: The original contract was issued as a labor hour contract and projected that Glowball Solutions would commit 35 hours per week to the development and technical support of PropC. Actual effort to date has ranged from 40 to 60 hours per week. The reasons for this increased effort are as follows: a. the R&D office accelerated the development and launch of a new version this year - portions of PropC were developed and tested immediately prior to usage b. additional requirements and revisions to the code were introduced as a result of an unplanned/unscheduled security review c. significant downtime and server problems required additional technical support d. increased meetings with the IT department and the R&D office to improve coordination. Any responsible sources may submit a capability statement or proposal for these services by 5:00 pm MST, September 29, 2009, which shall be considered by the agency.
