Description
RECOVERY THIS NOTICE IS PROVIDED FOR INFORMATION PURPOSES ONLY; THEREFORE FAR 5.203 DOES NOT APPLY. THIS OPPORTUNITY IS AVAILABLE ONLY TO CONTRACTOR UNDER THE CURRENT CONTRACT NUMBER: W91278-09-C-0020, R & D Maintenance Service, Inc., 409 N Main St., Hennessey, OK 73742-1017. Using Recovery Act funding, the Mobile District Corps of Engineers intends to issue a modification to contract number W91278-09-C-0020, a competitively awarded Cost-Reimbursable Plus Award-Fee contract for the Operation and Maintenance of Government-Owned Facilities and Equipment, Tennessee Tombigbee Waterway, Alabama and Mississippi, awarded to R&D Maintenance Services. The North American Industry Classification Systems Code (NAICS) 561210 applies to this contract. The modification will be funded by American Recovery and Reinvestment Act (Recovery Act) funds. Contract clauses required for projects involving Recovery Act funds have been incorporated into the contract. The modification will increase the level of effort required under the current contract as follows: 1) Performing maintenance of Okatibbee Dam to include sand drains at the downstream end of drains and drainage ditch. Install crushed rock wrapped in non-woven fabric so that seepage is conveyed more efficiently to the toe ditch. This work is within the scope of the original contract technical provisions and includes maintaining and repairing buildings, structures, facilities, and their mechanical, electrical, plumbing, sewage and water systems. The existing contract must be used for the following reasons: 1) the current contract will enable repairs to the dam to begin immediately after scope of work in completed. Due to weather construction window for work to be accomplished in the fall of FY-10, construction will be required to start within the next two months. 2) The Cost-Reimbursable Plus Award-Fee Contractor has the management, technical, and administrative skills to efficiently and effectively accomplish this work at a reasonable cost with an advantage of flexibility to readily adjust to any unforeseen obstacles encountered during construction. This flexibility is very important when working on the dam just before flood season, beginning in the winter months. The American Recovery and Reinvestment Act (ARRA) contains specific acquisition requirements that must be met when using Recovery Act funds, including compliance with the Federal Acquisition Regulation, and, to the maximum extent practicable, making fixed- price (FP) contract awards using competitive procedures. However, the Office of Management and Budget's guidance allows for the use of other than FP contracts. Although Mobile District's contract was not awarded as a FP contract, it was awarded competitively as a small business set aside, and the contract type was selected to provide the contractor with the greatest incentive for efficient and economical performance, given the types of services to be performed. The existing Operation and Maintenance contract has experienced personnel and documented performance to mitigate the Government's risk. In order to meet the requirements of the Act in the most prudent business manner within the time constraints imposed, existing Operation and Maintenance contracts are the most appropriate contractual vehicles for the work anticipated under this modification.
