Description
Questions and Answers- Amendment 0003 The purpose of this Revision 00003 to Solicitation Number DTOS59-09-R-00018 is as follows: 1. Extend the date of proposal submissions to November 2, 2009 (11/02/2009) at 1300 ET; 2. Provide DOT's responses to questions received; 3. Add an additional clause - Organization Conflict of Interest (OCI)Clause: (a) The parties to this contract agree that the Contractor and any members of the Contractor’s team including subcontractors and/or consultants will be restricted in its future contracting in the manner described below. Except as specifically provided in this clause, the Contractor shall be free to compete for other contracts on an equal basis with other companies. (b) Due to the fact that the Contractor, under the terms of this contract, or through the performance of work pursuant to this contract, is required to develop requirements and specifications that are currently contemplated to be incorporated into a DOT solicitation in the future, the Contractor shall be ineligible to perform the work described in that solicitation as a prime contractor or subcontractor under an ensuing DOT contract. This prohibition against competing on the follow-on contract is limited to a period of three years from the date of award of the design/build contract which incorporates the requirements or specifications resulting from this contract. (c) To the extent that the work under this contract requires access to proprietary or confidential business or financial data of other companies, as long as such data remains proprietary or confidential, the Contractor shall protect such data from unauthorized use and disclosure. See attached pages for Questions and Answers. The date of submission of proposals: 11/02/2009 at 1300 ET Proposals shall be submitted via email to Brenda.Mealer@dot.gov
