Description

The Department of Department of Veterans Affairs, Procurement Business Division, Tres Rios Building, San Juan Puerto Rico has awarded Contract No. VA248-C-1284 for the DB Dental Clinic Improvements. Below is the approved Justification and Authorization for used of other than full and open competition. MEMORANDUM Date: September 28, 2009 From:Contracting Officer (672/PBD) Subj: JUSTIFICATION AND AUTHORIZATION FOR USE OF OTHER THAN FULL AND OPEN COMPETITION; DB DENTAL CLINIC IMPROVEMENTS. To:File in reference to solicitation No. VA-248-09-RP-0651 1. AGENCY AND CONTRACTING ACTIVITY: Department of Veterans Affairs, Procurement Business Division, Tres Rios Building, San Patricio, 27 Ave. J. Gonzalez Giusti, Suite 600, Guaynabo, PR, 00968. 2. DESCRIPTION OF ACTION: Justification and approval for Other than Full and Open Competition. This procurement is a design build sole source construction with a Veteran Owned Small Business (VOSB). 3. DESCRIPTION OF SUPPLIES/SERVICES: Provide all labor, materials, tools and equipment, and design-build services necessary for the design and construction of the project described here in other specific tasks as further defined by this request of proposal. Work includes the furnishing of all professional architectural & engineering (A&E) design work; specialized construction labor & supervision work; materials & equipment's provision; and certain other related architectural, mechanical, structural, electrical, and demolition work as required by this contract, specifications and/or conceptual lay-out drawings. In addition, these services may include: pre-design services such as facility assessments, development of design programs, schematic designs, construction documents, technical studies, standards and specifications, and/or reports. Estimated cost is $150,950.00. 4. AUTHORITY CITED: FAR 6.302-5 Authorized or Require by Statute. 5. REASON FOR AUTHORITY CITED: The Government would be seriously injured unless the agency is not permitted to limit the number of sources from which it solicits proposals. Negotiation with the recommendable source will accelerate contract award process. This project was competed under Service-Disable Veteran-Owned Small Business (SDVOSB) lowest price technical acceptable and unable to make award for the following reasons: a. The station received nine (9) proposals. Six (6) out of nine were SDVOSB; three (3) proposals were between 40-59 percent above Government Estimate (GE), one (1) was 136 percent above GE and the two (2) non responsive. b. The remaining offerors; two (2) were Veteran Owned Small Business and one was not registered at the VetBiz Registry site. MSS General Contractors, Inc. proposal was the most suitable offer meeting both technical and price requirements; however, as previously mentioned, the procurement was an SDVOSB set-aside and not VOSB set-aside. It is more advantageous to the Government to initiate negotiations with MSS General Contractors, Inc., a Veteran Owned Small Business. This contractor meet all the requirements to complete the work listed in item 3 above. This project is crucial to improve dental clinic patient care service. 6. EFFORTS TO OBTAIN COMPETITION: Refer to paragraph 5. 7. FAIR AND REASONABLE PRICE DETERMINATION: A request for Proposal will be issued to the Contractor. Contractors proposal will be evaluated against the estimated cost. Negotiations will be held, if required, in order to reach a fair and reasonable price for both parties. 8. MARKET RESEARCH: A market survey was not conducted for this action. See paragraph 6 above. 9. OTHER FACTORS: None 10. INTERESTED SOURCES: MSS General Contractors, Inc. 11. ACTIONS TO INCREASE COMPETITION: None. 12.
