Service-Disabled Veteran-Owned Small Business
 
Description
The Department of Veterans Affairs (VA) has authority, pursuant toTitle 38 USC Chapters 18, 31, 35 and 36, to provide all services andassistance necessary to enable eligible Veterans with service-connecteddisabilities to obtain and maintain suitable employment and, if notemployable, achieve independence in daily living to the maximum extentfeasible. In the discharge of this responsibility, each VocationalRehabilitation and Employment Service Division (VR&E) within the VBARegional Office (RO) undertakes an initial evaluation of the Veteran todetermine his or her entitlement for these services and assistance anddevelops, in cooperation with the Veteran, an Individualized WrittenPlan of Services. Rehabilitation plans include: Individualized WrittenRehabilitation Plans (IWRP) that outline training and job placementservices needed to achieve employment goals; employment placement underan Individualized Employment Assistance Plan (IEAP); IndividualizedExtended Evaluation Plan (IEEP) to determine feasibility for employment;or if employment is not possible, services to enhance the Veteran'sindependence in daily living under an Individualized Independent LivingPlan (IILP). The Veterans Benefits Administration (VBA), Department of VeteransAffairs (VA) is charged with providing assistance to service-connecteddisabled Veterans through vocational rehabilitation and employment(VR&E) services. In order to assure services in close geographicproximity to Veterans and to provide timely services when staff turnoveroccurs, Contractor assistance may be required to supplement vocationalrehabilitation and employment services. Specialized services may alsobe required to complement services typically provided by VA staff. In order to provide these services, VR&E requires contractor assistancein the following areas: (1) initial assessment; (2) case managementservices; (3) job placement services to assist the Veteran in findingand maintaining suitable employment; (4) educational and vocationalcounseling; and (5) discrete services to provide for the specializedneeds of Veterans. The objective of this contract is to assist Veterans to obtain andmaintain suitable employment and to live as independently as possible intheir homes and communities. The resultant contract will be awarded for a 180 base period with two(2) 90-day option periods. VA NOTICE OF TOTAL SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESSSET-ASIDE (JUNE 2007) (a) Definition. In accordance with 38 U.S.C. 8127, for the Departmentof Veterans Affairs, "Service-disabled veteran-owned small businessconcern"- (1) Means a small business concern- (i) Not less than 51 percent of which is owned by one or moreservice-disabled veterans or, in the case of any publicly ownedbusiness, not less than 51 percent of the stock of which is owned by oneor more service-disabled veterans (or eligible surviving spouses) (38U.S.C. 8127(h) and (k)(2)(A)(i)); and (ii) The management and daily business operations of which arecontrolled by one or more service-disabled veteran (or eligiblesurviving spouse) or, in the case of a service-disabled veteran withpermanent and severe disability, the spouse or permanent caregiver ofsuch veteran (38 U.S.C. 8127(h) and (k)(2)(A)(ii)); and (iii) The business meets federal small business size standardsfor the applicable North American Industry Classification System (NAICS)code identified in the solicitation document (38 U.S.C. 8127(k)(1)); and (iv) The business is listed in the VetBiz.gov Vendor InformationPages, (http://www.VetBiz.gov). (2) "Service-disabled veteran" means a veteran, as defined in 38U.S.C. 101(2), with a disability that is service-connected, as definedin 38 U.S.C. 101(16). (3) "Surviving Spouse" is an individual as defined in 38 U.S.C.101(3). (b) General. (1) Offers are solicited only from service-disabled veteran-ownedsmall business concerns. Offers received from concerns that are notservice-disabled veteran-owned small business concerns shall not beconsidered. (2) Any award resulting from this solicitation will be made to aservice-disabled veteran-owned small business concern. (c) Agreement. A service-disabled veteran-owned small businessconcern agrees that, in the performance of the contract, in the case ofa contract for- (1) Services (except construction), at least 50 percent of the costof personnel for contract performance will be spent for employees of theconcern or employees of other service-disabled veteran-owned smallbusiness concerns; (2) Supplies (other than acquisition from a nonmanufacturer of thesupplies), at least 50 percent of the cost of manufacturing, excludingthe cost of materials, will be performed by the concern or otherservice-disabled veteran-owned small business concerns; (3) General construction, at least 15 percent of the cost of thecontract performance incurred for personnel will be spent on theconcern's employees or the employees of other service-disabledveteran-owned small business concerns; or (4) Construction by special trade contractors, at least 25 percentof the cost of the contract performance incurred for personnel will bespent on the concern's employees or the employees of otherservice-disabled veteran-owned small business concerns. (d) A joint venture may be considered a service-disabled veteranowned small business concern if- (1) At least one member of the joint venture is a service-disabledveteran-owned small business concern and makes the followingrepresentations: That it is a service-disabled veteran-owned smallbusiness concern, and that it is a small business concern under theNorth American Industry Classification Systems (NAICS) code assigned tothe procurement; (2) Each other concern is small under the size standardcorresponding to the NAICS code assigned to the procurement; (3) The joint venture meets the requirements of paragraph 7 of theexplanation of Affiliates in 19.101 of the Federal AcquisitionRegulation; and (4) The joint venture meets the requirements of 13 CFR 125.15(b). (e) Any service-disabled veteran-owned small business concern(non-manufacturer) must meet the requirements in 19.102(f) of theFederal Acquisition Regulation to receive a benefit under this program.
