- NASA/Goddard Space Flight Center (GSFC) intends to issue a Request for Proposal(RFP) for the Observatory Decks and Support Panels for the Magnetospheric Multiscale(MMS) Project.The scope of work for this procurement entails the Contractor providingthe facilities, personnel, services, tools, equipment, and materials to deliver theObservatory Decks and Support Panels in accordance with the Statement of Work, which willbe provided with issuance of the RFP. This procurement is restricted to U.S. offerorsbecause the RFP includes drawings listed as part of the Title 22 of the Code of FederalRegulations (CFR) 121, U.S. Munitions List. You are referred to 22 CFR 120, theInternational Traffic in Arms Regulations (ITAR), to determine if you are eligible toreceive these ITAR restricted drawings. The ITAR Section 120.14 defines person as anatural person as well as a corporation, business association, partnership, society,trust, or any other entity, organization or group, including governmental entities. ITAR Section 120.15 defines a U.S. person as a person (as defined in 120.14) who is alawful permanent resident as defined by 8 U.S.C. 1101(a)(20) or who is a protectedindividual as defined by 8 U.S.C. 1324b(a)(3).It also means any corporation, businessassociation, partnership, society, trust, or any other entity, organization or group thatis incorporated to do business in the United States. It also includes any governmentalentity. It does not include any foreign person as defined in 120.16 of this part. ITARSection 120.16, defines a foreign person as any natural person who is not a lawfulpermanent resident as defined by 8 U.S.C. 1101(A)(20) OR WHO IS NOT A PROTECTEDINDIVIDUAL AS DEFINED BY 8 U.S.C. 1324b(a)(3).It also means any foreign corporation,business association, partnership, trust, society or any other entity or group that isnot incorporated or organized to do business in the United States, as well asinternational organizations, foreign governments and any agency or subdivision or foreigngovernments (e.g. diplomatic missions).If you are eligible as defined above, please contact Julie Janus atJulie.A.Janus@nasa.gov or (301) 286-4931. Prospective offerors shall submit acertification to Julie.A.Janus@nasa.gov signed by an authorized official stating that thecompany is a U.S. entity per the ITAR at 22 CFR 120.15. Prospective offerors shall alsosubmit a Non Disclosure Agreement to Julie.A.Janus@nasa.gov stating that they will adhereto all U.S. export control regulations in proposing for and performing this contract. NASA would like to get all U.S. offerors cleared prior to RFP release so you may receivethe drawings on the same day as the RFP is officially released to the public. This procurement will be a full and open competition to U.S. persons only--excluding allforeign persons as mentioned above. NASA/GSFC anticipates awarding a Firm Fixed-Price type contract for this effort with ananticipated award date on or about January/February 2010. The Government does not intend to acquire commercial items using FAR Part 12. The actual due date forreceipt of offers will be stated in the prospective RFP. Upon issuance of the RFP, allqualified responsible sources may submit an offer which shall be considered by thisagency.
