This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. (ii) The solicitation number for this procurement is HDEC05-10-T-0001 and it is issued as a Request for Quotation (RFQ). (iii) This solicitation document and incorporated provisions and clauses are those in effect through the Federal Acquisition Circular (FAC) 2005-36, DFARS Change Notice 20090825, and Defense Commissary Agency Acquisition Regulations (DeCAARS) 2005 Edition. (iv) This solicitation is set-aside 100% for small business. The North American Industry Classification systems (NAICS) code is 238220, which has a small business size standard of $14 million. (v) Contract Line Item Numbers (CLINS) CLIN 0001 Contractor shall furnish all labor, tools, materials, equipment and transportation necessary to provide SCHEDULED quarterly preventive maintenance for the HVAC System located at the Defense Commissary Agency Headquarters, 1300 E Avenue, Building P11200, Fort Lee, Virginia. Quarterly preventive maintenance shall also include FILTER MAINTENANCE. See Attachment B for a listing of HVAC equipment and the required filters. Quarterly Maintenance Rate: $ ___________ per quarter Base Period: December 1, 2009 – May 31, 2010 CLIN 0002 Unscheduled/emergency maintenance to include repair/and or replacement of parts. Maintenance service shall be performed in accordance with the terms and conditions specified in the attached Statement of Work SOW. Base Period: December 1, 2009 – May 31, 2010 (vi) Description of Requirements: Contractor shall provide SCHEDULED quarterly periodic preventive maintenance and UNSCHEDULED maintenance on an "as needed" basis, for the HVAC System located at the Defense Commissary Agency Headquarters, 1300 E Avenue, Building P11200, Fort Lee, Virginia. Services shall include all personnel, parts, labor, tools, materials, and transportation for the equipment identified below in the attached scheduled of supplies and services. Services shall include cleaning, lubricating, oiling, aligning, adjusting, replacing filters, testing complete system, replacing parts and accomplishing major and minor repairs (minor repairs are repairs that can be accomplished on-site). Services shall be performed in accordance with the terms and conditions specified the Statement of Work (SOW). See Attachment A. (vii) The period of performance is six months – December 1, 2009 – May 31, 2010. FOB: Destination (viii) Provision at FAR 52.212-1, Instruction to Offerors - Commercial Items applies to this acquisition along with the following Addendum: Addendum to FAR 52.212-1 Instruction to Offerors – Commercial Items. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on letterhead stationery, or as otherwise specified in the solicitation. (ix) Provision 52.212-4501 IAW FAR 52.212-2, Evaluation-Commercial Items (Jan 1999) applies to this acquisition. (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: 1.Price 2.Past Performance I. Price: 1.Price will be evaluated by adding the total price for CLIN 0001 and CLIN 0002. An offeror’s total price will be calculated as follows: Offeror’s CLIN 0001 rate will be multiplied by 2 quarters (quarterly maintenance) Offeror’s CLIN 0002 Hourly Rate (Normal duty hours) will be multiplied by 260 hours Offeror’s CLIN 0002 Hourly Rate: (Other than normal duty hours) will be multiplied by 40 hours Offeror’s CLIN 0002 Trip Charge (Round trip) will be multiplied by 20 trip charges Offeror’s CLIN 0002 Percentage of mark up on parts will be multiplied by $10,000.00 Results of the above five calculations will then be added together to come up with a total price for evaluation purposes. The multiples used are only estimates used for evaluation purposes. The estimates used in the calculation in no way obligate the Government. 2.Labor rates should cover the required amounts as dictated by the Department of Labor Wage Determination No. 2005-2545, Revision No.11 dated 10/05/2009. See Attachment D. II. Past Performance will be evaluated based on the following sub-factors listed in descending order of importance: 1.Timeliness of Performance 2.Quality of Work 3.Business Relations In evaluating past performance, the Government will use the Past Performance Surveys (Attachment C) provided by the offeror’s references, and may use other sources of information, including, but not limited to federal, state and local government agencies, Better Business Bureaus, published media, electronic databases and contractor’s performance on DeCA contracts. The evaluation of past performance will consider relevant facts and circumstances. The Government will evaluate past performance as an indicator of future performance. The determination is a matter of judgment. The relative importance of the factors is: Price/price related factors are equal to past performance. (b) Options (if included in the Schedule). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (x) Offerors shall include with their offer a completed copy of the provision at FAR 52.212-3, OFFEROR REPRESENTATIONS AND CERTIFICATIONS-COMMERCIAL ITEMS (AUG 2009) and Alternate 1,. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor prior to expiration of the contract performance period. 52.219-28 – Post-Award Small Business Program Rerepresentation (Apr 2009) (a) Definitions. As used in this clause-- Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority. Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is “not dominant in its field of operation” when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity. (End of clause) 52.223-1 Biobased Product Certification (Dec 2007) As required by the Farm Security and Rural Investment Act of 2002 and the Energy Policy Act of 2005 (7 U.S.C. 8102(c)(3)), the offeror certifies, by signing this offer, that biobased products (within categories of products listed by the United States Department of Agriculture in 7 CFR part 2902, subpart B) to be used or delivered in the performance of the contract, other than biobased products that are not purchased by the offeror as a direct result of this contract, will comply with the applicable specifications or other contractual requirements. (End of provision) 52.223-2 Affirmative Procurement of Biobased Products Under Service and Construction Contracts (Dec 2007) (a) In the performance of this contract, the contractor shall make maximum use of biobased products that are United States Department of Agriculture (USDA)-designated items unless— (1) The product cannot be acquired— (i) Competitively within a time frame providing for compliance with the contract performance schedule; (ii) Meeting contract performance requirements; or (iii) At a reasonable price. (2) The product is to be used in an application covered by a USDA categorical exemption (see 7 CFR 2902.10 et seq.). For example, some USDA-designated items such as mobile equipment hydraulic fluids, diesel fuel additives, and penetrating lubricants are excluded from the preferred procurement requirement for the application of the USDA-designated item to one or both of the following: (i) Spacecraft system and launch support equipment. (ii) Military equipment, i.e., a product or system designed or procured for combat or combat-related missions. (b) Information about this requirement and these products is available at http://www.usda.gov/biopreferred. (End of clause) 52.223-11, Ozone-Depleting Substances (a) Definition. “Ozone-depleting substance,” as used in this clause, means any substance the Environmental Protection Agency designates in 40 CFR Part 82 as-- (1) Class I, including, but not limited to, chlorofluorocarbons, halons, carbon tetrachloride, and methyl chloroform; or (2) Class II, including, but not limited to hydrochlorofluorocarbons. (b) The Contractor shall label products which contain or are manufactured with ozone-depleting substances in the manner and to the extent required by 42 U.S.C. 7671j (b), (c), and (d) and 40 CFR Part 82, Subpart E, as follows: Warning Contains (or manufactured with, if applicable) *_______, a substance(s) which harm(s) public health and environment by destroying ozone in the upper atmosphere. * The Contractor shall insert the name of the substance(s). (End of Clause) 52.228-4500 LIABILITY TO THIRD PERSONS (APR 1997) The contractor shall be responsible for and hold the Government harmless from all claims on the part of persons not a party to this contract for personal injury, death, and property loss or damage caused in whole or in part by the fault or negligence of the contractor, his officers, agents, or employees in the performance of work under this contract. (End of Clause) 52.228-4501 VEHICLE OPERATION AND INSURANCE (DEC 2001) a. All private-owned and Contractor-owned vehicles shall be properly licensed, insured and safety inspected in accordance with applicable federal, state and local regulations. The following automotive liability coverage is required: (1) For Contractor-owned vehicles: Bodily injury $200,000 per person, $500,000 per occurrence; property damage $20,000 per occurrence. (2) For privately-owned vehicles: Bodily injury and property damage insurance meeting requirements of state in which vehicle is registered. b. Vehicles licensed or registered in a state which requires a mechanical safety inspection must display a valid inspection sticker. c. All vehicles operating at the installation are subject to the installation traffic code, copies of which are available in the office of the installation Provost Marshal. (End of Clause) 52.233-4500 INDEPENDENT REVIEW OF AGENCY PROTESTS (APR 2004) Offerors/bidders may submit their agency protest directly to the contracting officer or request an independent review at a level above the contracting officer. The independent review is available as an alternative to consideration of the agency protest by the contracting officer.
