Description
Tuesday, November 10, 2009 The Department of Veterans, VA Boston Healthcare System, has a requirement for Applied Biosystem Inc (ABI) to provide a maintenance service contract for: 1.Tempo Nano MDLC System; 2.QSTAR Elite Mass Spectrometer; and 3.PEAK N300 DR Gas Generator. The Mass Spectrometer and accessories were purchased from ABI on September 4, 2007. The service contract is to provide coverage for the Services of the Mass Spectrometers and accessories including repair, part, labor and travel expenses. The Mass Spectrometer is located at: Department of Veterans Affairs VA Boston Healthcare System Wing BD-8 150 South Huntington Ave Jamaica Plains, MA 02130 POC: Dr. Jinghua Yang Tel: 857-364-5611 eMail: JinHua.Yang@va.gov The service contract should include but is not limited to the following: "A multi-step process to obtain the certification to work on the instrumentation and software; "Have the full and exclusive access to the latest technical developments, repair procedures, software application updates and planned maintenance procedures; "Use only replacement parts certified to manufacturers' specifications; "Have access to the Global Technical Assistance Center (TAC) which is staffed by senior service engineers and provides the highest level of expertise for troubleshooting the instruments; "Not authorized any third-party service provider to perform maintenance and repair on the instruments. It is the Government's intention to solicit and negotiate only with this source. Please refer to the Sole Source Justification. This is not a solicitation; it is notice of intent to sole source a requirement. Also this notice of intent is not a request for competitive quotes. No solicitation document is available and telephone requests will not be accepted. However, any firm that believes it can meet these requirements may give written notification to the Contracting Officer within five (5) calendar days from the date of publication of this synopsis. Supporting evidence must be furnished in sufficient detail, to demonstrate the ability to comply with the above requirements. This information can be faxed to Christine Gorman at 774-826-3347. Responses will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. Inquires/information received after established deadline of Monday, November 16, 2009 16:00 EST shall not be considered. The submission of any data for review shall not impede award of this contract as planned. The Government does not intend to pay for information solicited. This synopsis is issued pursuant to FAR 6.302-1. Post in FBO today for 5 days i.e. Tuesday, 11/10/2009 16:00 pm EST Deadline Tuesday, 11/16/2009 16:00 pm EST JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION *1. Identification of the service/department and the transaction/requisition #: VA Boston Healthcare System: Research, 150 South Huntington Ave., Boston, MA 02130. *2. Nature and/or description of the action being approved: Preventive maintenance inspections and repair services (including parts and extended service hours) to maintain Mass Spectrometer which consisted of: 1)Tempo Nano MDLC System; 2)QSTAR Elite Mass Spectrometer; and 3)PEAK N300DR Gas Generator. *3. Description of the supplies/services required to meet the Agency's needs (including the estimated value): Service contract for Parts and labor to maintain and repair the Mass Spectrometer. Estimated value: Base Year:Estimated $35,468.33 from December 1, 2009 (or the date award) to September 30, 2010. Total estimated value (base year plus four (4) option years: $212,814.00. Period of Performance: Base Year plus four option years. 4. Identification of the statutory authority permitting other than full and open competition: Far part 6.302-1 only one responsible source and no other supplies or services will satisfy agency requirements. *5. Demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited: Contractor is the original equipment manufacturer and all parts are proprietary. No commonly available parts are available from outside the company. The company is the only source for the following Mass Spectrometer requirement: 1)Tempo Nano MDLC System; 2)QSTAR Elite Mass Spectrometer; and 3)PEAK N300DR Gas Generator. *6. Describe the efforts that have been made to ensure that offers are solicited from as many potential sources as is practicable, including whether a Commerce Business Daily notice was or will be publicized as required by Subpart 5.2 (copy attached) and, if not, which exception under 5.202 applies: Parts are propriety, not available from other sources. 7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable: The anticipated cost is fair and reasonable to the Government. *8. Description of the market survey that was conducted (i.e. names of firms and the date(s) the firms were contacted) and the results or a statement of the reasons a market survey was not conducted: The Mass Spectrometer was purchased from ABI 2007. ABI is the only vendor that has access to original equipment and parts. The original warranty of the machine expired on June 31, 2009. Note:Market researches which were done on the websites also indicated that ABI is the only source. *9. Any other facts supporting the use of other than full and open competition, such as - an explanation as to why technical data packages, specifications, engineering descriptions, statement of work, or purchase descriptions suitable for competition have not been developed or are not available. Repair parts are extremely expensive for this unit. If the system is not maintained and calibrated at regular intervals, extensive repairs will result. All parts and major assemblies will be covered by this contract. The company is the only source for the Mass Spectrometer that we purchased. *10. A listing of the sources, if any, that expressed an interest in the acquisition: None to date. *11. A statement of the actions, if any, that the department/service may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies/services is required in the future: Contracting Activity will continue to encourage full and open competition whenever possible.
