- Purchase Description This is notice of the Government's intent to negotiate a sole-source contract with Auto-Trol Technology Corporation, 11030 Circle Point Rd, Suite 450, Westminster, CO 80020; under the authority of 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements for Konfig.CM software maintenance. The agency's minimum needs can only be satisfied by the unique supplies available from only the above cited sources, which possess unique capabilities demonstrated as follows: 584 CBSS/GBHA manages and maintains all systems supporting management, sustainment, and view- and print-on-demand of electronic technical data for WR-ALC managed weapon systems. Equipment and related software comprising the center's technical data systems are utilized to provide critical technical data to over 6,000 users worldwide. A high level of system availability is critical to provide technical data necessary for operation and maintenance of USAF weapons systems to the vast customer base. System software support is required to ensure critical systems remain viable tools for customers performing activities which require the use of current technical data. Replacement of required systems software with products from other manufacturers would require extensive efforts to reconfigure the current environment and would jeopardize the stability of the existing system environment. Actions to migrate the technical data systems processes to other COTS software products would place at risk the center's ability to provide critical technical data in a timely manner to over 6,000 users and would significantly increase costs associated with WR-ALC technical data infrastructure. The COTS Konfig.CM product is manufactured and licensed by Auto-Trol Technology Corporation. Software maintenance must be purchased in order to ensure that necessary software enhancements and corrections can be implemented within the WR-ALC systems. Auto-Trol Technology Corporation is the only known source available for purchase of Konfig.CM software maintenance. The contractor identified is the only known source that can meet all of the requirements. This is not a competitive solicitation and quotes are not being requested. Any other responsible source capable of meeting the requirement may submit technical, delivery, pricing, and past performance data sufficient to determine capability. However, the determination to compete or not to compete this requirement is solely at the discretion of the Government. To be considered, any such documentation must be received NLT 11 December 2009, 12:00PM EST. Only electronic submissions will be accepted and no extensions will be granted. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.
