The United States Department of Agriculture (USDA) APHIS/PPQ/PBWRF (Pink BollWorm Rearing Facility), in Phoenix, Arizona intends contract to procure 10,000 to 60,000lbs of AGAR per year. All Subject to Sample Approval. This will be a firm fixed price Indefinite Delivery /Indefinite Quantity type Contract for the next 9 months with a possible additional of 2 years. All pricing to include any and all costs but not limited to: overhead, general and administrative costs, profit, and transportation. Base Period 01/01/2010 - 9/30/2010 Period 1 10/01/2010 - 09/30/2011 Period 2 10/01/2011 - 09/30/2012 The PBWRF uses agar as a binding agent in the artificial insect diet prepared for rearing larvae of the pink bollworm. Contrary to most artificial insect diets containing agar, the pink bollworm diet is not left intact as poured, but is shredded into noodles approximately 5 mm wide and of varying thickness and length. Because of this special method of use, the agar acts more as a binding agent than it does a gelling agent as in other insect diets. As such, the requirements are more critical in terms of physical properties especially the strength of the gel (1.34% concentration) and the ability to retain moisture for a relatively long period of time. The agar supplied shall be the dried product of the water soluble extract of a species of Pterocladium, Gelidium or Gracilaria confervoides. Excessive moisture loss from the diet results in two problems. If the loss comes from moisture-holding capability of the agar, the nutrients in the diet become too concentrated and if the loss comes from excessive syneresis, the resultant free moisture causes the death of neonate larvae by drowning. In the case of the pink bollworm, the artificial diet not only provides the larvae with essential nutrients for their development, but also provides their living space. The agar shall not inhibit growth or reproduction of Pink Bollworm and must conform to the specifications listed above. (a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from 12 months from contractor award or option exercised. (b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control. (c) If mailed, a delivery order or task order is considered "issued" when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the Schedule. 52.216-22 Indefinite Quantity. (a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract. (b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum." The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum." (c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations. (d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after 12 months from contract award or option exercised. 52.232-19 Availability of Funds for the Next Fiscal Year. AVAILABILITY OF FUNDS FOR THE NEXT FISCAL YEAR (APR 1984) Funds are not presently available for performance under this contract beyond 09/30/2010. The Government's obligation for performance of this contract beyond that date is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise for performance under this contract beyond 09/30/2010, until funds are made available to the Contracting Officer for performance and until the Contractor receives notice of availability, to be confirmed in writing by the Contracting Officer.
