Description
By way of this Notice and in accordance with the provisions of FAR 6.302-1, the Chicago District, US Army Corps of Engineers, announces its intention to award a sole source FOLLOW - ON contract to Smith Root Incorporated (SRI) of Vancouver, Washington, for the purpose of acquiring additional supply and install services, whereby, SRI will supply and install their uniquely designed and patented pulse generators to enable the proper operation of the Dispersal Barrier IIB electronic systems. Under this District's previously issued sole source contract to SRI, the company supplied and installed the pulse generator devices, which are customized and are considered the only ones of its type capable of meeting the demands of the Dispersal Barrier technology. All intellectual property rights pertaining to these unique components belong exclusively to SRI, including, but not limited to copyrights, patents and trademarks which are expressly reserved to SRI and covered by their Patent 4750451. Further, SRI has research, proprietary arts, trade secret technology not open to the public that they use in fish barrier designs and components therein; thereby making SRI the only source capable of satisfying the government's requirements of this proposed contract. To further add, the assembly (customization) and installation of these key components will require the use of SRI's uniquely skilled and highly reliable labor force, already having the intimate knowledge of the Barrier's mechanical and electronic systems. Under their previously awarded contract, SRI performed at an optimal level, as its labor force demonstrated its capabilities to properly assemble their patented components, and remain on schedule to meet the critical timeframes imposed by the tight overall project schedule. In this regard, it is deemed necessary to obtain the supply and install services from the original source (SRI) to continue an agile operation of the Barrier without disruption and to avoid a substantial duplication of cost that is not expected to be recovered by way of competition. In addition, the government cannot afford any delays in fulfilling the agency's requirements since the Barrier itself protects the ecosystem from two species of Asian carp. The massive and voracious fish, which can grow to 4 feet long and weigh 100 pounds, are known for their ability to leap up to 8 feet out of the water as motor boats speed by, injuring fishermen. Scientists fear that the fish, which can eat the equivalent of 40 percent of their body weight every day, could damage the ecosystem of the Great Lakes, which is the largest fresh water system on earth. Under the proposed contract, all work including system testing will be complete September 30, 2010 (includes time for delivery and install of the components). The contract will result in a firm-fixed price supply contract. This notice does not constitute a solicitation for offers, proposals, etc. However, interested firms may send a capabilities statement NO LATER THAN the close of business on January 15, 2010.
