Description: Solicitation Number: W912D1-10-T-0054 Notice Type: Notice on Intent to Sole Source Synopsis: The United States Army Contingency Contracting Expeditionary Command of South West Asia, Kuwait (CCEC-SWK) intends to negotiate and award a firm fixed price purchase order on a Sole Source basis to Rapiscan Systems Incorporated, 2805 Columbia Street, Torrance, CA 90503-3804, Cage Code 04HU6. The anticipated award shall be made under the Authority of 10 U.S.C. 2304(c)(1) and FAR 6.302-1(A), - Unique or innovative supplies or services available from only one source or only one supplier with unique capabilities. The planned contract is to be awarded to Rapiscan Systems, Inc for the acquisition, delivery, installation, training, preventive maintenance, and corrective maintenance of twelve (12) Secure 1000 (5000) Series Whole Body Imagers. This award shall also include Spare Parts Kits that shall be pre-positioned to support the number of equipments in the area of responsibility (AOR). Market research was previously conducted and it has been determined that this is a sole source requirement IAW FAR 6.302-1. This is not a request for competitive proposals and no solicitation is available. All interested sources must respond in writing with clear and convincing evidence to support their ability to provide the items as noted above within 10 days of this publication. A determination by the Government to make a sole source award based on responses that may be received in response to this Notice of Intent is solely within the discretion of the Government. The market research obtained by the Government prior to this Notice of Intent to Sole Source to Rapiscan Systems Incorporated has convinced the Government, prior to consideration of any responses to this Notice of Intent, that the service and supplies planned for procurement, as addressed above, are only available from Rapiscan Systems Incorporated. The Rapiscan Secure 1000 is a proprietary lutra low dose X-ray scanner system which is utilized throughout the Central Command (CENTCOM) Arear of Operations (AOR). Rapiscan Systems Incorporated does not currently have an agreement with sub-contractors to acquire their equipment nor do they allow non Rapiscan certified Field Service Representative (FSR) to install or perform maintenance on their equipments due in large part because of Rapiscans proprietary technology. This purchase shall be under Simplified Acquisition Procedures and Other Than Full and Open Competition as authorized under FAR 13.106-1(b). The anticipated award date is on/about April 5, 2010.
