Description
JUSTIFICATION AND APPROVALTO PROCURE USING OTHER THAN FULL AND OPEN COMPETITION 1. Identification of Agency and Contracting Activity. This Justification and Approval (J&A) for Other Than Full and Open Competition is executed by the CAI Frederick, Frederick, MD, on behalf of the Department of Veterans Affairs (VA), Compensation and Pension Service division. 2. Nature/Description of Action. This activity proposes to negotiate a noncompetitive award (sole source) with AMTIS, Inc., for the procurement of services for: Customer Satisfaction Survey Cards and Reports. 3. Description of Supplies/Services. The purpose of this requirement is to continue services with the incumbent who is currently conducting support for the Medical Disability Examination Contract Program for the Department of Veterans Affairs (VA) Compensation and Pension Service division. The contractor is responsible for receiving and analyzing Veteran and active duty service members' customer service survey cards regarding the quality of the service provided by the medical disability examination contractor. This task order involves tallying responses to five survey questions and one comment section in which it is clearly identified, if a Veteran/service member wishes to be contacted by VA, a place for a contact information is shown. Veterans' and active duty service members' responses to this survey instrument (cards) shall contain the contractors' (or government) business reply mail permit number and be mailed to the contractor by the Veterans/service members for tabulation and analysis. In addition, comments received from Veterans/service members that require follow up action by the medical contractor or VA shall be forwarded by email within two business days of receipt. A follow up action is defined as any comment requiring further investigation of a complaint or concern regarding a particular visit and when a Veteran/service member specifically asks to be contacted. AMTIS Inc is currently providing assistance to VA under their existing award. The estimated value of this requirement to support the Medical Disability Examination project is $361,801.98, $271,351.48 for the base year and $90,450.50 for the four-month option year. 4. Identification of Statutory Authority. The statutory exception permitting other than full and open competition for this acquisition is 10 U.S.C. 2304(c)(5), Authorized or Required by Statute as implemented by FAR 6.302-5. The applicable statute is PL 109-461, Veterans First Contracting Program. 5. Demonstration of Contractor's Unique Qualifications. AMTIS Inc has provided VA contractual assistance for the past year in support of the medical disability examination contract customer survey project. Under their current award AMTIS has exceeded expectation in the assistance of this crucial element of the program. They have also met their milestones and have provided timely delivery of all reports. AMTIS is a Service Disabled Veteran Woman-Owned Small Business with competencies in an array of disciplines that include management, administration, and technical and instructional services specialists. They have a staff of competent senior-level subject matter experts and professional consultants. This procurement requires services that AMTIS is already familiar with in regards to VA's mission for the medical disability examination project. The new procurement requires support of program development and management for the critical area as noted in paragraph 2. Securing AMTIS to provide continuity from the previous work they provided will ensure that this project will continue to be successful in meeting Veterans' needs. 6. Description of efforts made to ensure offers are solicited from as many potential sources as practicable. This acquisition was not synopsized in the Federal Business Opportunity System pursuant to the exception granted at FAR 5.202(a)(4). 7. Determination of Fair and Reasonable Prices. No award shall be made until the Contracting Officer determines the costs to the Government to be fair and reasonable. This determination will be based on a comparison of the GSA schedule pricing, current contract pricing, and AMTIS's proposal. 8. Description of Market Survey. N/A. The basis for this sole source is for continuity of services in the medical disability examination contract customer survey project.. In accordance with FAR 6.302-5, a sole source award will be made to AMTIS who is performing work for the VA's transformation initiative under an existing award. 9. Actions Taken to Remove Barriers to Competition. All future requirements will be handled on a case-by-case basis.
