- The details of the proposed acquisition under SPM1C1-10-R-0073 are as follows: The Government shall purchase the requirement under two solicitations for the purchase of Jacket, Soft Shell (Mid-Weight), Cold Weather (ECWCS Generation III) Universal Camouflage Pattern (UCP), Layer 5 under NSN 8415-01-538-6808(s): Solicitation SPM1C1-10-R-0073 will be for a a minimum of 8,000 each, annual estimated quantity (AEQ) of 25,600 each and a maximum of 32,000 each. Two term options will be included for the same quantities cited as the base year. Each solicitation will contain the following notice: "The Government intends to make two awards under separate solicitations for different quantities of the same items covered by this solicitation. The intent is to have different contractors for each of the separate contracts that will be awarded under this and the other solicitation. In order to ensure that multiple sources are available and to ensure the continuous availability of reliable sources of supplies, the Government reserves the right to exclude under the authority of FAR 6.202, an awardee under one of these separate solicitations from being eligible for award under this solicitation. A determination will be made at time of award if the use of FAR 6.202 is needed to ensure the continuous availability of reliable sources of supplies or be in the best interest of national defense in having multiple facilities available for furnishing the supplies in case of a national emergency or industrial mobilizations for these go to war items. The separate solicitations are SPM1C1-08-R-0170 and SPM1C1-10-R-0073.” Offers are to be based on FOB Destination to the New Cumberland, PA depot. Production Leadtime is 120 days after date of award. Solicitations will be issued as a Service Disabled Veteran-Owned Small Business (SDVOB) set-aside. Therefore, ONLY SDVOBs may offer. Purchase Description (PD) GL/PD-06-05 dated Dec 28, 2007 and Pattern Date June 19, 2007 are applicable. An acquisition utilizing Best Value/Source Selection procedures is anticipated for the purchase of the above items. A technical proposal will be required with the following factors being evaluated: 1. Product Demonstration Model 2. The solicitations are estimated to be issued by February 2010 with a 30-day closing. Availability of solicitations, FAR 5.102(d) applies, as our office no longer issues solicitations or amendments in paper form. Offeror should register to receive notification of this solicitation or solicitation amendments. Copies of this solicitation can be found on the DIBBS website at https://www.dibbs.bsm.dla.mil. It is the responsibility of the contractors to access this website and place the request for specifications and patterns. The Defense appropriations and authorization acts and other statutes (including what is commonly referred to as “The Berry Amendment”) impose restrictions on the DoD’s acquisition of foreign products and services. Generally, Clothing and Textile items (as defined in DFARS clause 252.225-7012) and components thereof, must be grown, reprocessed, reused, or produced in the United States, its possessions or Puerto Rico, unless one of the DFARS 225.7002-2 exceptions applies.
