Description
Reference is made to Solicitation No. W912DQ-09-R-0013 and Contract No. W912DQ-10-D-3013, Indefinite Delivery/Indefinite Quantity Contract for Environmental Compliance and Remediation Services. The Government intends to make an award to a fourth firm, thereby increasing the number of firms, from three to four, under this multiple award contract. The four firms will share the Joint Total Acquisition Value of $25 Million. This fourth award will be to HDR|e2M. The proposal submitted by e2M in March 2009, in response to the subject solicitation, was highly rated by the Source Selection Evaluation Board. As a result of e2Ms change of ownership, announced in June 2009, the Contracting Officer considered e2M to be ineligible for an award under the subject solicitation. Subsequent to the award of three contracts to three other firms in November 2009, e2M filed a protest and requested that a size determination be made by the Small Business Administration (SBA). According to the formal size determination rendered by the SBA on December 16, 2009 (see attached), the company HDR|e2M was determined to be eligible for an award under the subject solicitation. Since the proposal submitted by e2M was highly rated; and since the SBA has ruled that the firm HDR|e2M is eligible for award under the subject solicitation, the Government has elected to make this fourth award.
