Description
DEPARTMENT OF VETERANS AFFAIRS Justification Review Document For Other Than Full and Open Competition 1. Contracting Organization: VA Black Hills, Fort Meade, SD 2. Description of Action: A Firm Fixed-Price contract is contemplated for acquisition of construction services from McCarthy-Anderson Construction for emergency sewer line repairs at Fort Meade VA Medical Center, Sturgis, SD. The sewer line under Dietetics is partially blocked and appears to be broken and/or collapsed. In the process of investigating the blockage, the VAs snake camera has become lodged in the damaged pipe and cannot be removed. The pipe may become completely blocked at any time, so it is imperative that the problem be resolved immediately to insure continued operation of a large portion of Dietetics. 3. Description of Commodities: Work consists of removing vinyl asbestos tile and asbestos mastic removal, removal of concrete, excavation, replacement and compaction of soil, demolition and replacement of cast iron pipe, replacement of concrete, new flooring, acoustical ceilings and painting. Dietetics must continue its daily operations throughout the duration of these repairs and the contractor may be required to work off hours to accomplish the work. 4. Statutory Authority: 41 U.S.C. 253 (c)(2) 5. Validity of Use of Statutory Authority: This contractor has successfully completed many projects at this facility and has established a history of responsiveness, competence and cost control in these types of situations. They also have the manpower and experience to complete this work immediately. If not corrected as soon as possible, the sewer line may become completely blocked and seriously impact the continued operation of Dietetics and the mission of the hospital. There is an unusual and compelling urgency for the government to resolve the problem as soon as possible. Therefore, in accordance with Federal Acquisition Regulation (FAR) 6.302-2, Statutory Authority 41 U. S. C. 253 (c)(2) is being cited. 6. Sources Solicited: McCarthy-Anderson Construction was the first vender contacted based on their past performance on similar projects and their availability to take on the project immediately. 7. Market Research Conducted: Due to unusual and compelling urgency, a minimal Market Survey was completed. McCarthy-Anderson Construction has provided prompt and competent response to previous problems and emergencies at the facility in the past, and were the first contractor contacted. McCarthy Anderson Construction is a small, woman owned business. 8. Other Facts Supporting the Use of Other Than Full and Open Competition: The following reasons are cited for choosing McCarthy Anderson Construction as a sole source contractor: McCarthy Anderson Construction has successfully completed many projects at this facility and has established a history of responsiveness, competence and cost control in these types of situations. They have the manpower and experience to complete this work immediately. They are familiar with the facility, the environmental and security requirements. 10. Actions to remove Barriers to Competition: All of the existing cast iron sewer pipe in the area excavated will be checked and replaced if necessary. This action should prevent any blockages in this area in the foreseeable future and thus mitigate the need for emergency repairs in this area. 11. Fair and Reasonable Price: Pricing for previous work performed by this contractor has always been in line with Government estimates. We anticipate negotiations with this vendor to result in a fair and reasonable price, as determined by the prepared Government estimate, as well as the prevailing costs for this type of work in this area. 12. Contracting Officer's Certification: Based upon the information provided herein, I believe the justification for awarding this project to McCarthy-Anderson Construction on a sole-source basis is accurate and complete to the best of my knowledge and recommend we proceed as such. ________________________________________ Contracting Officerdate concur ________________________________________ Warranted One Level Above COdate NOTE: Additional approvals may be required at a level as high as the Agency Senior Procurement Executive (for procurements exceeding $50,000,000.
