*NOTE: The attachment to this solicitation should reflect the following changes in DATE and TIME. Site visit has been rescheduled for Wednesday, 24 February 2010 at 2:00PM EST. 1. This is a combined synopsis/solicitation for installation of awning to cover the lobby and patio area of the Community Activities Center in accordance with the format in the Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; a written solicitation will not be issued. 2. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-38. 3. The NAICS code is 238160 and the size standard is $14M. 4. This solicitation contains one line item: Install awning to cover the lobby and patio area of the Community Activity Center- Contractor shall provide all labor, personnel, equipment, tools, materials, supervision, transportation and other items and services necessary to perform the service as stated in the attached statement of work, Qty: (1) each. 5. Place of Performance: Community Activities Center on Andrews AFB, MD. FOB: Destination 6. The following FAR provisions apply: 52.212.1: Instructions to Offerors, applies to this acquisition. Multiple offerors and awards are hereby deleted from this solicitation. All quotes must be for the complete requirement, partial quotes will not be considered. Award will be made to a single vendor. Non-Price Factors (Not to Exceed 1 page) Bid Schedule (Not to Exceed 1 page). 52.212-2: Evaluation of Commercial Items applies. Addendum to Paragraph (a), The Government will award a purchase order resulting from this RFQ to the most responsive, responsible offeror whose offer represents the best value to the government. The Government reserves the right to enter into and agreement with other than lowest offeror. The government intends to enter into an agreement without discussions, nevertheless, the government may communicate with an offeror in order to clarify or verify information submitted in its offer. 7. Offerors must submit a completed copy of the provision at FAR 52.212-3, Offeror Representation and Certifications Commercial, with its offer. FAR 52.212-3 can be downloaded from the Internet: http://farsite.hill.af.mil/. Offerors that fail to furnish the required representation information, or reject the terms and conditions of the solicitation, may be excluded from consideration. DFARS 252.212-7000 Offeror Representations and Certifications - Commercial Items (Nov 1995); and DFARS 252.225-7000, Buy American Act-Balance Payment Program Certificate (Apr 2003) with the quotation. 8. The following FAR clauses are applicable: FAR 52.212.4, Contract Terms and Conditions Commercial Items, with addendum; 52.212-3, Government Furnished Property, FAR 52.212-5, and Notice to Supplier, 52.245-4. 11. The provision at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statues or Executive Orders Commercial Items (Jun 2003), applies to this acquisition, and specifically the following FAR clauses under paragraph (b) are applicable: 52.222-19, Child Labor-Cooperation with Authorities and Remedies (Sept 2002); 52.222-21, Prohibition of Segregated Facilities (Feb 1999); 52.222-26 - Equal Opportunity (Apr 2002); 52.222-35 - Equal Opportunity for Special Disabled Veterans, Veterans of the Vietnam Era, and Other Eligible Veterans (Dec 2001); 52.222-36 - Affirmative Action for Workers With Disabilities (Jun 1998); 52.222-37 - Employment Reports on Special Disabled Veterans, Veterans of the Vietnam Era, and Other Eligible Veterans (Dec 2001); 52.225-13 -Restrictions on Certain Foreign Purchases (Jun 2003); and 52.232-33 - Payment by Electronic Funds Transfer--Central Contractor (May 1999). The clause at DFARS 252.212-7001, Contract Terms and Conditions Required to Implement Statues or Executive Orders Applicable to Defense Acquisitions of Commercial Items (June 2003), applies to this acquisition, and specifically the following clauses under paragraph (b) are applicable: 252.225-7001 - Buy American Act and Balance of Payments Program (Apr 2003); 252.232-7003 - Electronic Submission of Payment Requests (Mar 2003). The following DFARS clauses are hereby incorporated into this solicitation: 252.225-7002, Qualifying Country Sources and Subcontractors (Apr 2003); and 252.204-7004, Required Central Contractor Registration (CCR) (Nov 2001). NOTE: CCR can be obtained by accessing the Internet, http://www.ccr.gov or by calling 1-888-227-2423. The CCR number must be obtained before award can be made. 9. Quotations must be received no later than 12:00 pm local time, March 1, 2010. The Government requires that all offers are e-mailed to the point-of-contact below with contractors name listed in the subject block. Facsimile proposals will be accepted at 301-981-1931. Place of Contract Performance: Community Activities Center Andrews AFB, MD 316 CONS-001 IAW AFDWI 90-1, The Contractor shall be required to observe quiet hours during outdoor ceremonial events. Quiet hours shall be in effect 30 minutes prior to commencement and one hour after the start of all outdoor ceremonial events. 316 CONS-004 AAFB Environmental Standards (19 Oct 2006) Environmental Compliance. Offerors are reminded of the environmental requirements contained in the solicitation to comply with all applicable federal, state, and local environmental statutes and regulations. In addition to the scrutiny of civil environmental regluatory and enforcement agencies, environmental compliance incidental to Air Force activities or on Air Force property is subject to Air Force scrutiny. The Air Force routinely investigates environmental violations and cooperates fully with civil authorities to secure remedies and discourage future violations. Failure to comply with environmental statutes and regulations can subject the contractor to criminal and civil penalties and/or contractual sanctions including, but not limited to, termination, suspension, and debarment, and adverse past performance assessment. Contractors can obtain specific information regarding environmental compliance mandates in 316 WG/CC Memo "Andrews AFB Environmental Standards" dated 19 Oct 2006. Additional information can be obtained by contacting the base environmental flight. 316 CONS-007 PERSONNEL SECURITY REQUIREMENTS AFI 31-501 (27 Jan 2005) The contractor shall not employ any person for work on this contract if such employee is identified as a potential threat to the health, safety, security, general well being or operational mission of the installation and its population, nor shall the contractor employ any person under this contract who has an outstanding criminal warrant as identified by the National Crime Information Center (NCIC). NCIC checks will verify if a person is wanted by local, state, and federal agencies. All contractor personnel must consent to NCIC background checks. Contractor personnel who do not consent to an NCIC check will be denied access to the installation. Information required to conduct an NCIC check includes: full name, driver's license number/state issued/expiration date, social security number, and date of birth of the person entering the installation and shall be submitted in conjunction with the contractor's request for vehicle passes. Completion of a successful NCIC check does not invalidate the requirement for an escort when contractor personnel are working within controlled or restricted areas. Contractors shall ensure their employees and those of their subcontracts have the proper credentials allowing them to work in the United States. Persons later found to be undocumented or illegal aliens will be remanded to the proper authorities. The contractor shall not be entitled to any compensation for delays or expenses associated with complying with the provisions of this clause. Furthermore, nothing in this clause shall excuse the contractor from proceeding with the contract as required. The contractor shall flow this clause down to all subcontracts. 5352.201-9101 Ombudsman. OMBUDSMAN (AUG 2005) (a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions). (c) If resolution cannot be made by the contracting officer, concerned parties may contact the Center/MAJCOM ombudsmen, Diane Dade, AFDW/SB, 1535 Command Drive Suite E-210, Andrews AFB, MD (301) 981-7342, fax (301) 981-6538, email: Diane.Dade@afncr.af.mil. Concerns, issues, disagreements, and recommendations that cannot be resolved at the MAJCOM/DRU level, may be brought by the concerned party for further consideration to the Air Force ombudsman, Associate Deputy Assistant Secretary (ADAS) (Contracting), SAF/AQC, 1060 Air Force Pentagon, Washington DC 20330-1060, phone number (703) 588-7004, facsimile number (703) 588-1067. (d) The ombudsman has no authority to render a decision that binds the agency. (e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the Contracting Officer. (End of clause) 316 CONS-013 - Invoice Instructions for Non-Appropriated Funding Invoice instructions for payment via Non- Appropriated Funding. Payment will be disbursed after acceptance of supplies or services from the 316th Services Squadron. The vendor should submit the invoice to the POC listed below to receive payment. Submit invoices to: 316 SVS/SVFR Attn: Gwen Jones 1535 Command Drive Suite B-201 Andrews AFB, MD 20762 STATEMENT OF WORK FOR COMMUNITY ACTIVITY CENTER PATIO AWNING I. PROGRAM OBJECTIVE: The Contractor shall provide goods and services as identified in Article I item number 2. The Contractor shall provide all labor, travel, materials, tools, equipment, supplies or sub-contractors in performance of the service. ARTICLE I: That: 1. The 316th Force Support Squadron, Community Activity Center, a NAFI, is requesting the refurbishing and enhancement of the Community Activity Center to include lobby and patio. 2. The contractor shall provide the following items. • Fabricate and install one patio awning that is "L" shaped • Measures 88' long on each leg with projections 28' and 32' • Use framework with corrosion resistant, zinc galvanized Gatorshield polymer and chromate coated structural steel tubing • Utilize high strength, abrasion resistant, flame retardant vinyl laminate, with anti wicking, anti fungal properties. • Use existing Golf Course Awning as an example of required construction and material. 3. The Contractor shall provide all labor, travel, materials, tools equipment, supplies or sub-contractors in performance of the service. 4. The contractor shall ensure the work site area will be free of any outside debris during installation and upon completion of project. ARTICLE II: The Contractor must: 1. Provide products and services of a quality satisfactory to the NAFI manager or his or her duty authorized representative. 2. Coordinate with the Community Services Flight Chief (301-981-9330) concerning access and to facility and any additional coordination's required.. 3. Obtain insurance for all non-government property and merchandise used by the contractor in the operation of their duties against theft, fire, storm, flood, and damage, or destruction through any other force of nature; or in lieu thereof, to relieve the NAFI from any liability arising from such theft, loss, damage, or destruction. The contractor must provide proof of insurance to the Contracting Officer. 4. Comply with all memoranda, bulletins, and letters of instruction issued by the Contracting Officer. 5. Keep the service area clean, orderly, and safe to the satisfaction of the NAFI Manager or his or her representative. 6. Indemnify, save harmless, and defend the NAFI from and against any and all claims, demands, actions, debts, liabilities, and attorney's fee arising out of, claimed on account of, or in any manner predicated on loss of or damage to the property of, and injuries to or death of any and all persons whatsoever, in any manner or caused or contributed to by the Contractor, his or her agents, servants, or employees while in, on, or about the military installation wherein the Recreation Vehicle Lot is located, or while departing from the same; and to indemnify and save harmless the NAFI from and on account of damages of any kind which the NAFI may suffer as the result of acts of negligence, fraud, or misconduct of any Contractor's agents, servants, or employees. ARTICLE III: The Contractor must not: 1. Request or permit itself to be represented to the public as an agent or employee of the NAFI by use of the name of the NAFI on letters, bills, signs, or by any other means. The contractor, its servants, agents, and employees are in no sense agents of the United States, the NAFI, the commander of the installation within which the contractor operates, or of any other entity having to do with the operation of the NAFI. 2. See or remove any property that is owned by the NAFI or any other part of the Federal Government and is used in the operation of the Recreation Vehicle Lot. 3. Loan money to or borrow money from customers or others, which includes Federal Government (including NAFI) employees and military personnel. 4. Sell merchandise or service on credit. 5. Give or offer to any officer or employee of Services, or any other part of the Federal Government, any gift, privilege, special benefits, discounts, or anything else of material or personal nature whereby the individual or employee would receive preferential treatment, when such is not available to the general public. ARTICLE IV: The NAFI will: 1. Ensure Community Activity Center work area is ready for contractor to perform the duties stated in this statement of work. 2. Pay the contractor upon completion of service and submission of a valid invoice. ARTICLE V: That: 1. This contract, unless sooner terminated as herein provided, may be extended for additional periods, each of which may not exceed 12 months by mutual agreement of the parties in writing, subject to approval in the same manner as this instrument. 2. This contract is automatically terminated in the event that the 316th Force Support Squadron is dissolved.
