Description
RECOVERY - THIS NOTICE OF INTENT IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY, AND IS IN COMPLIANCE WITH THE TRANSPARENCY AND ACCOUNTABILITY REQUIREMENTS IN ACCORDANCE WITH THE AMERICAN RECOVERY AND REINVESTMENT ACT OF 2009 (ARRA), PUBLIC LAW 111-5. The U.S. Department of Commerce, National Institute of Standards and Technology (NIST) posted a sources sought notice on November 19, 2009 for Solicitation No. SB1341-10-RP-0012, to identify potential sources that could satisfy the requirements as described in that sources sought notice. NIST evaluated all responses. One company responding to the sources sought notice was a Service Disabled Veteran-Owned Small Business (SDVOSB). In an effort to determine if a SDVOSB set-aside would be appropriate, NIST conducted a Dynamic Small Business search of SDVOSB companies by NAICS code. All identified companies were contacted to determine if they were interested in this requirement. By the established due date, no responses were received. As a result of NIST's evaluation of responses to the sources sought notice, and the additional market research done by specific outreach, NIST identified only one well-qualified Service-Disabled Veteran-Owned Small Business (SDVOSB) that can perform the requirements set forth in that sources sought notice. Therefore, pursuant to the authority set forth under the Veterans Benefits Act of 2003 (15 U.S.C. 567f), NIST intends to negotiate and award a sole source labor-hour type contract with Coley and Associates, Inc., San Antonio, TX, which is a SDVOSB. In accordance with FAR 16.602, a labor hour type contract has been determined as the most suitable vehicle for this requirement due to the uncertainties involved with contract performance, and the fact that is not possible to accurately estimate the extent of Contractor effort to complete all of the assigned tasks under the contract.
