- DEPARTMENT OF VETERANS AFFAIRSJustification and Approval For Other Than Full and Open Competition 1. Contracting Organization: Department of Veterans Affairs, VISN 20, Spokane VAMC 2. Description of Action: This is a request for other than full and open competition for the procurement of temporary general transcription services for a time period of 90 days. 3. Description of Supplies or Services: The contractor shall provide medical transcription services of dictated material for the Spokane, WA VA Medical Center (hereafter referred to as VA, VAMC, or the government) seven days a week, 24 hours a day, within prescribed turn-around-times. Contractor will transcribe reports utilizing headers and footers and appropriate formats. All dictated reports shall be transcribed off line and then up loaded directly into VISTA. Reports shall be uploaded into VISTA in a timely manner as to meet the required turn-around-times identified in the contract. Batch uploading is not allowed. 4. Statutory Authority: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; (X) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement ( ) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5. Validity of Use of Statutory Authority: General transcription services are a very important clinical support service that can affect patient care and safety. All General Transcription services for the Spokane VAMC would cease if we could not obtain this bridging contract. VISN 20 is currently soliciting for a network wide contract which is scheduled for award prior to May 31, 2010. Due to clinical requirements and patient safety issues the Spokane VAMC needs to issue a bridge temporary general transcription service contract to fill a three month gap (or until the VISN contract is awarded). 6. Actions to Promote Competition: None at this time. With only a three (3) month gap, it does not make sense to set up another vendor in the VISTA system and complete a background investigation. It would take considerable time to complete these processes and would cause general transcription services to cease during this time period, creating a patient safety issue. 7. Determination of Fair and Reasonable Price: The anticipated price to the Government is $9,000 for three months. Pricing has been offered at the current rate from Certified Medical Transcription Services. This rate has been determined fair and reasonable based on past competition. 8. Market Survey (FAR 7.102): None. 9. Other Considerations: FAR 6.302-2 (b) states that "Delay in award of a contract would result serious injury, financial or other to the Government"; General Transcription services are a critical patient care and safety service. 10.
