Description
Notice Type:Pre-solicitation Synopsis: The Department of Veterans Affairs, Portland VA Medical Center intends to issue a sole source contract to Beecher Instruments, Inc. for the following supply: Beecher Manual Tissue Arrayer II (MTAII) for the Research Service at the Portland Veterans Administration Medical Center. This notice of intent is not a request for quotes. The Government intends to acquire supplies via FAR 6.302-1. Interested organizations may submit expressions of interest (EOIs) containing sufficient literature to the extent necessary to allow the government to determine the technical acceptability of specification. The aforementioned information should be submitted in writing to the Contract Specialist (email: mathew.berta@va.gov). Oral communications are not acceptable in response to this notice. This notice of intent is to a request for expressions of interest (EOI), proposals or quotations. No solicitation document exists and no telephone inquiries will be accepted. No contract award will be made on the basis of EOIs, proposals or quotations received in response to this notice. Interested persons may identify their interest and capability to respond to the requirement, and should furnish detailed data concerning their capability to provide the supply sought including pricing data, technical data sufficient enough to determine that a comparable source to the government is available. The government will be the sole determiner regarding an offers ability to meet all requirements. The government will consider all EOIs received prior to 5 days after the date of the publication of this synopsis before 10:00 am EST on that date. Below is the Justification for the aforementioned supply, in accordance with FAR 11.105: JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION Upon the basis of the following justification, I hereby approve the issuance of the contractual action described below using other than full and open competition, pursuant to the authority cited herein. Identification of Agency Department of Veterans Affairs, Portland VA Medical Center, 3710 SW Veterans Hospital Road, Portland, OR 97239. This purchase will be under the Simplified Acquisition Procedures and other than Full and Open Competition as authorized under FAR 13.501 (a) (1). The anticipated award date is February 24, 2010. Nature of Action Being Approved: This justification and approval set for the facts and requests approval for the issuance of a sole source contract with Beecher Instruments Inc. to supply the Research Service at the Portland Veterans Administration Medical Center. The proposed cost is $27,995.00. Description of Service and Supplies: Beecher Instruments, Inc. will provide a Beecher Manual Tissue Arrayer II (MTAII). The statutory authority for this justification is FAR 6.302-1, only one responsible source and no other supplies or services will satisfy the agency requirements. Justification Rationale: Beecher Instruments, Inc. is the only vendor that provides the MTAII. Beecher Instruments holds the exclusive, world-wide intellectual property rights covering tissue microarrayers. Beecher sells its equipment directly to researchers inside the United States and is therefore the sole source of Beecher branded equipment for the Portland VA Medical Center's Research Service.
