RMG 0010 0008(11) Contract Line Item Number(s): Five (5) 0001-Basic Contract: May 3, 2010 through September 30, 2010 0002-Option 1: October 1, 2010 through September 30, 2011 0003-Option 2: October 1, 2011 through September 30, 2012 0004-Option 3: October 1, 2012 through September 30, 2013 0005-Option 4: October 1, 2013 through September 30, 2014(12) Contract Award Date: 4/23/2010(13) Proposed Contractor: N/A(14) Description: The Miami Agency, through the Department of the Interior, Bureau of Indian Affairs (BIA)-Eastern Oklahoma Region, requires Prosecutorial services for the Court of Indian Offenses (CFR), located at 34 A Street N.E., Miami, Oklahoma 74354. Prosecutorial service is required to provide all of the necessary qualified personnel, materials, and supplies except those which may be provided by agreement with the Bureau, to perform the services in criminal, juvenile, and minor's in need of care cases for the Court's trial, and Children's Court Division. This action is to procure a basic year contract with four (4) 1 year options. - Quantity: 1- Unit of issue: EA- Delivery schedule:Basic Contract: May 3, 2010 through September 30, 2010 Option 1: October 1, 2010 through September 30, 2011 Option 2: October 1, 2011 through September 30, 2012 Option 3: October 1, 2012 through September 30, 2013 Option 4: October 1, 2013 through September 30, 2014The Prosecutor shall be responsible for the prosecution of all cases arising within the jurisdiction of the Court including, criminal, juvenile, and child welfare cases. The Prosecutor shall be responsible for assisting the Bureau of Indian Affairs' Law Enforcement Division; performing the normal duties of prosecuting criminal incidents; and working with the Federal Bureau of Investigation, Court Personnel, Agency Superintendent, Legal Assistants, and the Court Magistrate. The Prosecutor shall also provide supervision to any Assistant Prosecutors. a.The Prosecutor shall be primarily responsible for the prosecution of all cases arising within the jurisdiction of the Court. Specifically, the Prosecutor shall be responsible for the following: i.The prosecution of all juvenile and criminal cases in the Court. ii.The prosecution of other cases of public interest including child welfare cases arising within the Court's jurisdiction and child welfare cases transferred to the Court pursuant to the Indian Child Welfare Act of 1978, 992 Stat. 3069, USC 1901-52 that may arise in Court. b.The Prosecutor shall assist the Bureau of Indian Affairs Law Enforcement Program by: i.Providing legal and technical opinions on questions of law; ii.Coordinating investigations with the Bureau Law Enforcement personnel on criminal complaints and incidents on trust lands; iii.Coordinating investigations with the Bureau Law Enforcement personnel and Tribal Social Services personnel concerning child welfare complaints and incidents on trust lands; iv.Preparing the necessary legal documents for legal proceedings, such as complaints, warrants, petitions, subpoena's, and summons for court action in criminal and Indian Child welfare cases involving child welfare, neglect and abuse; v.Prosecuting and litigating criminal and Indian Child welfare cases involving child welfare neglect and abuse filed in Court. c.The Prosecutor shall perform the normal duties associated with prosecuting incidents to the orderly administration of a criminal case by: i.Screening all case reports and incident reports for possible prosecution; ii.Screening and processing citizen complaints for misdemeanor criminal violations on trust lands; iii.Screening and processing citizen complaints concerning child welfare, neglect and abuse; iv.Gathering and analyzing evidence in cases and reviewing pertinent decisions, regulations, policies, and other legal matters pertaining to the case; v.Appearing against accused in court of law and presenting evidence before the Magistrate or jury. d.The Prosecutor shall work cooperatively with the Federal Bureau of Investigation, the Bureau of Indian Affairs Law Enforcement personnel, Magistrates, Legal Assistant (Court), Tribal Officials and the Miami Agency Superintendent, in the performance in the above duties. e.The Prosecutor shall designate specific day(s) per month with duty hours when prosecutorial staff will be physically present at the Court. His/her shall be: i.Responsibility not only includes serving as Court Prosecutor, but also the supervision of any Assistant Prosecutors. ii. Assist the Legal Assistant (Court) by providing legal and technical assistance on questions of law and procedure. iii.If the contract provides for a Chief Prosecutor and assistants, the Chief Prosecutor shall be on site in each court at least once a month to review the work of any Assistant Prosecutor, and to make court appearances in complicated type cases requiring an experienced prosecutor. f. Additional Requirements: i. Contractor shall be a licensed member of the Oklahoma Bar Association. iiContractor shall have knowledge of the laws that govern the Court, Title 25 and the Tribal Laws of the seven Indian Tribes within the Court's jurisdiction.(15) Place of Contract Performance: Court of Indian Offenses 34 "A" St N.E. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: i. Professional qualification in Tribal, ICW and procedural law involved in criminal and juvenile procedures within the CFR Court. ii. Past CFR experience and familiarity, of respondent, to 25 CFR Part 11, with respect to performance of the services required. iii. Past Performance iv. Technical Capability v. Proposed Price. b. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. Note: Technical and past performance when combined with all evaluation factors other than cost or price, are significantly more important than cost or price. (26) Offerors are to include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications -- Commercial Items, with its offer.(27) The clause at FAR 52.212-4, Contract Terms and Conditions -- Commercial Items, applies to this acquisition.
