Description: THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIALITEMS PREPARED IN ACCORDANCE WITH THE FORMAT IN FAR SUBPART 12.6-STREAMLINED PROCEDURES FOR EVALUATION AND SOLICITATION FOR COMMERCIAL ITEMS-AS SUPPLEMENTED WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; QUOTATIONS ARE BEING REQUESTED, AND A WRITTEN SOLICITATION DOCUMENT WILL NOT BE ISSUED. This solicitation is being issued using Simplified Acquisition Procedures. This solicitation is a Request for Quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) (FAC) 2005-38 effective February 1, 2010 and class deviation 2009-O0009. The associated North American Industrial Classification System (NAICS) code for this procurement is 334516 with a small business size standard of 500 employees. However this requirement is unrestricted and all interested Contractors may submit a quote. The National Institute of Standards and Technology is seeking to purchase an Agilent Maintenance Agreement-Network GCMS 5973 Turbo System. Brand Name Only Justification: NIST requires maintenance including travel, repair and parts for preventative maintenance for a Network GCMS 5973 Turbo System. All of the equipment is explicitly manufactured by and purchased from Agilent. The Agilent technicians are uniquely and specifically trained and certified for repairing the equipment. Line items 0001 and if exercised 0002, 0003, 0004 and 0005 are BRAND NAME ONLY requirements. All interested Contractors shall provide a quote for the following: LINE ITEM 0001: Quantity One (1 YR) Agilent Maintenance Agreement-Network GCMS 5973 Turbo System. End of Support Life Date: 30-Nov-2013. 3.59864B/US60110716-Ion Gauge Controller R-28R Connections. Contractors shall meet or exceed the following minimum specifications: Agilent Advantage Silver (R-28R). The Agilent Advantage Silver service plan includes Telephone Support to Isolate and Resolve Hardware and Software Problems, Service Center Repair* and On-site Hardware Troubleshooting and Repair with Standard Response time. All labor, travel costs, and service parts, including Consumable Parts Required for Repair, are included. Additionally included is one Preventive Maintenance, and upon availability: Agilent Remote Advisor-Assist, Agilent Remote Advisor- Report, and Agilent Remote Advisor- Alert. QUOTATION EVALUATION: Evaluation Factors: The Government will evaluate information based on the following evaluation criteria: 1) Technical capability-offeror shall demonstrate that the service offered is the Brand Name and offeror is authorized by Agilent to sell the required Maintenance and 2) Price. Award shall be made to the responsible Agilent authorized source whose technically acceptable quotation represents the lowest price. Evaluation of Technical Capability shall be based on the information provided in the quotation. The quotation submitted shall be evaluated to determine that the equipment meets or exceeds all required specifications. If an offeror does not indicate whether its proposed equipment meets a certain minimum requirement, NIST will determine that it does not. PROVISIONS AND CLAUSES: 52.217-5 Evaluation of Options Except when it is determined in accordance with FAR 17.206(b) not to be in the Government�s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s). (End of Provision) 52.217-7 Option for Increased Quantity�Separately Priced Line Item The Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor within LINE ITEM 0002: within 1 year of the base award LINE ITEM 0003: within 2 year of the base award LINE ITEM 0004: within 3 year of the base award LINE ITEM 0005: within 4 year of the base award Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree. Offerors that fail to furnish required representations of information or reject the terms and/or conditions of the solicitation may be excluded from consideration. All quotes shall be sent to the National Institute of Standards and Technology, Acquisition Management Division, Attn: Janet Lamb, Building 301, Room B175, 100 Bureau Drive, Stop 1640, Gaithersburg, MD 20899-1640.
