- NOTICE INFORMATION:This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-38 including amendments effective December 10, 2009. This requirement is a 100% Small Business set-aside under NAICS Code 561110. Only qualified offerors under this NAICS code may submit a response. REQUIREMENT:The Navy Supply Information Systems Activity (NAVSISA) has a requirement for Administrative Support Services. The Performance Work Statement (PWS) for this effort is attached hereto. EVALUATION FACTORS:The order resulting from this solicitation will be awarded on a firm-fixed price basis and will be for a base period of one year with two one-year options. The Government estimates that only one contractor resource is necessary. A trade-off best value source selection will be conducted. The order resulting from this RFQ, if any, will be issued to the responsible vendor whose quote conforming to the RFQ is determined most advantageous to the Government considering the two factors listed below in descending order of importance: a)Technical Ability/Skills: Technical ability/Skills will be evaluated in accordance with Section 11.0 of the Performance Work Statement.b)Price: Provide a price quotation broken down by labor categories, prices per hour, quantities of hours per category, other direct costs in support of the labor and monthly totals. Travel is anticipated for this requirement. Factor (a) is significantly more important than factor (b). The Government reserves the right to issue an order based on initial quotes without discussions. Also, the Government reserves the right to award an order to other than the lowest priced or highest technically rated vendor. The work is for 40 hours per week, with some flexibility in scheduling during the week, subject to TPOC approval. The following local clauses are incorporated by full text: Contractor Access to (Unclassified) Information Systems (Sep 2008)(NAVSUP)Department of Navy (DON) policy prescribes that all unclassified data at rest that has not been approved for public release and is stored on mobile computing devices shall be treated as sensitive data and encrypted using commercially available encryption technology. A contractor employee, whose work involves access to sensitive unclassified information, warrants a judgment oftrustworthiness. Therefore, each contractor employee will have a favorably completed National Agency Check with Written Inquiries (NACI) to ensure the contractor employee assigned to the command will have an investigation equivalent to the National Agency Check with Local Credit Checks (NACLC). This investigation must be current within 10 years.DON will no longer permit the assignment of non-U.S. citizen contractor personnel to IT-I and IT-II designated positions. Requests to waive the U.S. citizenship requirement for designated IT-IIpositions may be submitted through the command Security Manager to CNO (N09N2). IT position designations are incorporated in paragraph 5B-2 of SECNAV M-5510.30.For contractor personnel who currently have a favorably adjudicated NACLC, the Facility Security Officer (FSO) will use the visitor certification program in the Joint Personnel Adjudication System (JPAS) or a visit authorization request (VAR) to provide the individuals' investigative information to the Security Manager of the command visited. The contractor will include the IT Position Category per SECNAV M-5510.30 for each person designated on a VAR. The VAR will be renewed annuallyor for the duration of the contract if less than one year. The contractor FSO or security representative will ensure that individuals assigned to the command are U.S. citizens and will ensure completion of the SF-85P. The SF-85P along with the original signed release statements and two applicant fingerprint cards (FD 258) will be forwarded to the command Security Manager for receipt at least one week prior to reporting for duty. The responsibility for providing the fingerprint cards rests with the contractor. The Security Manager will review the form for completeness, accuracy and suitability issues. The completed SF 85P alongwith attachments will be forwarded to the Office of Personnel Management (OPM) who will conduct the NACI investigation. All contractor personnel will in-process with the Security Manager and Information Assurance Manager upon arrival to the command and will out-process prior to their departure. The completed SF-85P will be reviewed by the Security Manager for completeness, accuracy and suitability prior to submission. If the contractor appears suitable after the questionnaire has been reviewed, the request will be forwarded to OPM. If there are eligibility issues, the FSO will be advised that the contractor is unacceptable by the Security Manager. OPNAV Form 5239/14, the System Authorization Access Request Navy (SAAR-N), is required for all individuals accessing Navy Information Technology resources. Failure to provide the required SF-85P, signed release statements, fingerprint cards and the SAAR-N at least one week prior to the individuals' report date will result in delaying the reporting date. Personnel cannot be properly processed and provided system access prior to their reporting date without receiving the investigative paperwork one week prior. Once the investigation is complete, the results are forwarded by OPM to the DON Central Adjudication Facility (CAF) for a position of trust determination. The DONCAF determination will appear in JPAS as either "Favorable" or "No Determination Made." Decisions of "No Determination Made" indicate that significant derogatory information is present that prevents a favorable suitability determination. Please note that the determination of the DONCAF is final; there is no due processaccommodation for positions of trust. That decision is final. If the determination is "No Determination Made," the contractor employee will not be permitted to continue on the contract and will be removed immediately. In order to maintain access to required systems, the contractor shall ensure completion of annual Information Assurance (IA) training, monitor expiration of requisite background investigations, and initiate reinvestigations as required. (End of Clause) NON-DISCLOSURE AND NON-USE OF DATA(a)DataAll data obtained, received, or learned by the Contractor and/or its personnel as a result ofperformance of this contract shall be deemed to be "sensitive" and/or "proprietary" whether or notsuch data is so designated or marked. The Contractor and its personnel shall restrict access todata obtained, received, or learned as a result of performance of this contract to the minimumnumber of Contractor personnel necessary for performance of this contract. No one who preparesoffers, proposals, bids, and/or quotations for Government and/or non Government procurementsshall be involved in direct performance of this contract. The Contractor shall ensure that each of itspersonnel who obtains, receives, or learns data as a result of performance of this contractunderstands and complies with this "Non-Disclosure and Non-Use of Data" clause.(b)Non-Disclosure of DataThe Contractor and its personnel shall disclose data obtained, received, or learned as a result ofperformance of this contract only to Contractor personnel directly performing under this contractand to United States Department of Defense personnel to whom disclosure of such data is requiredin performance of this contract. The Contractor and its personnel shall not disclose such data toanyone who prepares offers, proposals, bids, and/or quotations for Government and/or nonGovernment procurements. The Contractor and its personnel shall take all steps necessary toprevent disclosure of such data except as specifically permitted herein.(c)Non-Use of DataThe Contractor and its personnel shall use data obtained, received, or learned as a result ofperformance of this contract only in direct performance of this contract and for no other purpose. The Contractor and its personnel shall not use or consider such data in the preparation of any offer,proposal, bid, and/or quotation for any Government and/or non Government procurement. TheContractor and its personnel shall take all steps necessary to prevent use of such data except asspecifically permitted herein. (d)Non-Disclosure/Non-Use AgreementsBefore any of the Contractor's personnel becomes involved in performance of this contract, theContractor shall provide to the Contracting Officer a non-disclosure/non-use agreement signed bythat person. The non-disclosure/non-use agreement shall state that: (1) He/she shall disclose data obtained, received, or learned by him/her as a result of performance of this contract only to Contractor personnel directly performing under this contract and to United States Department of Defense personnel to whom disclosure of such data is required in performance of this contract. (2) He/she shall not disclose data obtained, received, or learned as a result of performance of this contract to anyone who prepares offers, proposals, bids, and/or quotations for Government and/or non Government procurements.(3) He/she shall use data obtained, received, or learned as a result of performance of this contractonly in direct performance of this contract and for no other purpose.(4) He/she shall not use or consider data obtained, received, or learned as a result of performance of this contract in the preparation of any offer, proposal, bid, and/or quotation for any Government and/or non Government procurement. In the event that the Contractor and/or its personnel will obtain, receive, or learn data of otherentities as a result of performance of this contract, the Contractor shall execute a non-disclosure/non-use agreement with each such entity. The Contractor shall provide suchexecuted non-disclosure/non-use agreement with an entity to the Contracting Officer prior to theContractor and/or its personnel having access to the data provided by the entity. (e)Requirement to Disclose DataIf the Contractor receives a court order requiring disclosure of data obtained, received, or learned as a result of performance of this contract or if the Contractor believes disclosure of such data isotherwise required by law or regulation, the Contractor shall contact the Contracting Officerimmediately and fully inform the Contracting Officer of the court order or other requirement prior to any disclosure of data. (f)Exception This "Non-Disclosure and Non-Use of Data" clause does not apply to data which the Contractor can demonstrate was obtained, received, or learned in a way other than as a result of performance ofthis contract. (g)Government Remedy Any violation of the terms of this "Non-Disclosure and Non-Use of Data" clause is a material andsubstantial breach of this contract, and the Government may, in addition to any other remedyavailable, terminate this contract, or any part thereof, for cause or default. SECTION 508 COMPLIANCESection 508 of the Rehabilitation Act requires Federal agencies to make their electronic and information technology accessible to people with disabilities. This applies to all Federal agencieswhen they develop, procure, maintain, or use electronic and information technology.All electronic and information technology (EIT) procured through this task order must meet the applicable accessibility standards specified in 36 CFR 1194.2, unless an agency exception to thisrequirement exists. Any agency exceptions applicable to this task order are listed below.The standards define Electronic and Information Technology, in part, as any equipment or interconnected system or subsystem of equipment, that is used in the creation, conversion, or duplication of data or information. The standards define the type of technology covered and set forthprovisions that establish a minimum level of accessibility. The application section of the standards(1194.2) outlines the scope and coverage of the standards. The standards cover the full range of electronic and information technologies in the Federal sector, including those used forcommunication, duplication, computing, software, networks, peripherals and other types of electronic office equipment. PRIVACY ACT During performance of this order, the contractor may have access to Privacy Act data. Should this occur, the contractor shall safeguard all privacy information, and ensure this data is accessed and maintained in accordance with applicable laws and regulations. If access occurs, FAR 52.224-1 and 52.224-2 apply.
