Description
NASA/DFRC has a requirement to extend the performance period of the DFRC SecuritySupport Services Contract for a maximum of ten months (April 1, 2010 - December 31,2010); said extension will consist of one two (2) month performance period and seven (7)one-month option periods, the exercise of each option being determined by the Governmenton a monthly basis. A contract modification reflecting this extension will be issued onor before March 31, 2010, which is the expiration date of the current security supportservices contract. NASA DFRC intends to extend the period of performance of contractNNA04AC17D, for protective services which was awarded as a result of full and opencompetition under a GSA Schedule to Wackenhut Services, Inc. (WSI)on November 1, 2004.This extension is necessary to bridge the performance period between the end of thecurrent contract and resolution of the current protest challenging NASAs agency-widecontract which was awarded on May 20, 2008 for Protection Services (i.e. Security guardservices, potential fire/fighting/prevention services, and potential emergency medicalresponse services). Authorization of this extension has been issued by NASA Headquarters under PIC-09-04A,dated December 29, 2009 which provides a class deviation from the requirements of FAR17.204(e) and NFS 1817.204(e)(iii), limiting the terms of service contracts to five (5)years, including the basic contract and all options. This class deviation applies only toexisting contract requirements that will ultimately be provided under the agency-wideNASA Protective Services Contract (NPSC). NASA is using the authority for Other Than Full and Open Competition provided by 10U.S.C. 2304(c)(1). Because Wackenhut Services, Inc. (WSI) possesses unique expertise inmeeting the security requirements of the Center, no alternate source could adequatelyprovide for the maintenance of the Centers comprehensive security program during thisextension period. Award to another source when the agency-wide contract for protectiveservices has been recently awarded, and while the resolution of the protest is nearingcompletion, would result not only in a substantial duplication of cost to the Governmentthat is not expected to be recovered through competition, but also in unacceptable delaysin fulfilling the agency's requirement. The Government does not intend to acquire a commercial item using FAR Part 12.See Note26.Interested organizations may submit their capabilities and qualifications to perform theeffort in writing to the identified point of contact not later than 4:30 p.m. local timeon March 31, 2010. Such capabilities/qualifications will be evaluated solely for thepurpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and opencompetition basis, based upon responses to this notice, is solely within the discretionof the government.Oral communications are not acceptable in response to this notice. All questions MUST bein writing and should be directed to Mr. Medina not later than 4:30 p.m. local time onMarch 31, 2010. All responsible sources may submit an offer which shall be considered by the agency.An Ombudsman has been appointed.
