Description
The Department of State, Office of Acquisitions, intends to issue a Urgent and Compelling award to Glock Inc., Smyrna, GA for the acquisition of (1) Pistol, Model G19-9mm Frame finger groove and rail frame, trijjicon night sight, 8lb trigger, Magazine: 6 hi cap mags, quantity: 250; (2) Pistol, Model G19-9mm Frame finger groove and rail frame, trijjicon night sight, 5.5lb trigger, Magazine: 6 hi cap mags, quantity: 100; (3) Accessory: G-19 Magazines MF 19115 (15 round), quantity: 1,000. This is for information purpose only. DoS POC is Bernice Barnes, 703-875-6098. JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. It is recommend the Department of State use other than full and open competition for the acquisition of GLOCK 19’s. The estimated cost is $129,000.00 2. Nature and/or description of the action being approved. It is required that the GLOCK 19’s be purchased to issue or train the agents deployed to various overseas posts. These weapons and accessories will enable them to provide continued protection for personnel overseas. Additionally, continued safe travel and protected movement is required for high level U.S. Embassy and Consulate officials while traveling overseas, and for Ambassador level officials serving in international organizations working to restore and maintain economic and social stability. 3. A description of the supplies or services required meeting the agency’s needs. The Glock 19 must meet the following specifications: Number of safeties = 3, Length (slide) = 6.85 in., Height = 5 inches, Width = 1.18 inches, Length between sights = 5.98 inches, Barrel length = 4.02 inches, Length of twist = 9.84 inches, Barrel profile = right hand twist, hexagonal profile, Magazine capacity = 17, weight of pistol without magazine = 20.99 ounces, Weight of empty magazine = 2.46 ounces, Weight of full standard magazine = ~8.99 ounces, Trigger pull = ~5.5 pounds, Trigger travel for discharge = ~0.5 inches. 4. An identification of statutory authority permitting other than full and open competition. The statutory authority permitting other than full and open competition is 41 USC 253 ©(1). The regulatory authority is FAR 6.302-2, Unusual and compelling urgency. (2) When the agency’s need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for. 5. Demonstration that the proposed contractor’s unique qualifications or nature of the acquisition requires use of the authority cited. Under the Diplomatic Security and Antiterrorism Act of 1986, The Bureau of Diplomatic Security has a broad range of responsibilities that include the protection of personnel and facilities, both domestic and abroad. Without the weapons requested, the Diplomatic Security Service will be unable to provide the proper level of security and protection. The Glock M19 Pistol is a unique item that only GLOCK manufactures and comes in specific configuration for DS agents. Glock can also deliver to meet the agency’s required delivery date. These items must be SA-7 by June 10, 2010. 6. Description of efforts made to ensure that offers were solicited from as many potential sources as practical: Previous requirement was purchased in November 2009. 7. Determination of the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. The Contracting Officer has determined that the anticipated cost to the Government will be fair and reasonable based on previous purchase history for this requirement. 8. A description of the market research conducted and the results or statement of the reason a market was not conducted. GLOCK, Inc. is the only legitimate source of the M19 Pistol. As such, GLOCK is the sole source supplier. 9. Any other facts supporting the use of Other than Full and Open Competition. The weapons have been requested for the agents who were trained on the use of the Model 19, which are issued to all of the existing agents currently in the field. The weapons requested are needed to equip the agents with the weapons will use as a part of the Worldwide Security Supplemental Upgrade. The economic impact to the U.S. Government for using other items than what is requested, would be great and would involve the re-training of all agents and DEAV armorers in the field including purchasing all new weapons to issue to the various mission locations be it overseas or abroad. The Bureau of Diplomatic Security has verified that the requirement as described meets the minimum requirements of the government. 10. A listing of sources, if any, that expressed in writing, an interest in the acquisition: This requirement will be posted in FedBidOps IAW FAR Part 5.203(1). 11. A statement of the actions, if any, the Agency may take to remove or overcome any barriers to competition before any subsequent acquisition of the supplies or services required. The Contracting Officer will ensure all sources capable of providing these weapons are solicited IAW FAR Part 5.2.
