- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1. Contracting Organization: Department of Veterans Affairs, VISN 20, VAPSHCS. 2. Description of Action: This is a request for other than full and open competition for the procurement of evaluation and repair of 7900HT ABI PRISM instrument. 3. Description of Supplies or Services: Evaluation and repair of 7900HT ABI PRISM instrument serial number 201603 located in room 614, building 1. 4. Statutory Authority: ( x ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; ( x ) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement ( ) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5. Validity of Use of Statutory Authority: Emergency repair of specialized equipment is only allowed by the manufacturer to ensure utmost quality. An authorized document of the manufacturer was provided to demonstrate sole proprietorship of products and services. Following procedures as defined in FAR 13.302-2(b)(2)(i) Unpriced Purchase Orders. 6. Actions to Promote Competition: Sole source justification will be posted on FBO following contract award. 7. Determination of Fair and Reasonable Price: Rates have been established by Applied Biosystem published rates for all customers and no discount is provided. Applied Biosystem charges a standard initial diagnostic rate of $3,500.00 that includes emergency travel, technical services, diagnostic tools, and administrative related charges. Performing a diagnostic at a later date may result in additional repair charges. It is estimated that the diagnostic will take approximately 1.5 hours to perform. The total cost of this emergency PO can either increase or decrease depending upon what is required to perform. This initial quote 403058255 stated these terms and conditions. 8. Market Survey (FAR 7.102): ABI is a sole source and this is an emergency repair order that is beyond the VA's control. No other vendor can perform this service. 9. Other Considerations: The repair is required due to another VA contractor who accidentally damaged Applied Biosystem's equipment. A claim will be processed by the VA to obtain lost funds for this fault. 10. Requirements Certification: I certify that the requirement outlined in this justification is a bonafide need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
