- VA-260-10-RQ-0620 This is a SOURCES SOUGHT NOTICE for market research purposes only to determine the availability of potential businesses with capabilities to provide the items described below. Potential offerors are invited to provide feedback via e-mail to Darlene Anderson at Darlene.Anderson4@va.gov. Responses will be used to determine the appropriate acquisition strategy for a potential future acquisition. 0001 - Provide and deliver Total Parenteral Nutrition (TPN) solution, including amino acid, Dextrose, electrolytes, and trace elements (to be refrigerated) as per prescription. 1000 ml bag x Estimated 100 each 1500 ml bag x Estimated 1 each 2000 ml bag x Estimated 600 each 2500 ml bag x Estimated 1 each 3000 ml bag x Estimated 365 each 0002 - Provide and deliver Multivitamin Concentrate Injection as per prescription x Estimated 1,000 vials. 0003 - Provide and deliver Intralipid 50 Gm as per prescription x Estimated 1,067 each. The intended contract period is a one-year base period plus (4) four one-year option periods. The Capabilities Statement for this sources sought is not expected to be a Request for Quotations, Request for Proposals or Invitation for Bids, nor does it restrict the Government to an ultimate acquisition approach, but rather the Government is requesting a short statement regarding the company's ability to provide the items listed above. Any commercial brochures or currently existing marketing material may also be submitted with the capabilities statement. Submission of capabilities statement will assist our office in tailoring the requirement to be consistent with industry standards. The capabilities will be evaluated solely for the purpose of determining to Set-Aside for the Small Business Community or to conduct as an Unrestricted Procurement. Other than small businesses may respond to this notice in the event the market does not indicate SB interest. This synopsis is for information and planning purposes only and is not to be construed as a commitment by the Government. The Government will not pay for information solicited. Respondents will not be notified of the results of the evaluation. All interested contractors should notify this office in writing or via email by 4:00 PM Pacific Daylight Time on April 15, 2010. The DRAFT Statement of Work follows. DRAFT Statement of Work VA Puget Sound Health Care System Pharmacy Home Total Parenteral Nutrition Services 1.It is estimated that one or more Veterans may require contract services as stated herein, at any one time. The number of Veterans will fluctuate during the term of the contract due to program enrollment. Some Veterans may remain with the program for the entire period of the contract and others only for a portion of such time. 2.The contractor shall provide direct delivery to the patient(s) and provide other services as specified herein, for the Veteran's health, comfort, safety, and welfare while allowing him/her to remain at home. All direct deliveries shall be FOB Destination at the residence of the Veteran(s) located throughout the State of Washington and the Pacific Northwest, as specified at the time of the order. This does not preclude delivery to a skilled nursing facility if the Veteran is residing in a skilled nursing facility. The contractor is responsible for the appropriate temperature controls and other care of the product(s) during delivery and assuring patient actually receives the product (e.g., product is not left on the porch). 3.Department of Veterans Affairs (VA) Puget Sound Healthcare System clinical staff will to work with one contractor, and one location if the contractor has multiple locations, to conduct all business. If a patient is outside Washington State or the Pacific Northwest or needs to travel outside these areas, the contractor shall coordinate care with other branches of its company or subcontract the work. All invoices shall be generated from the contractor's office under the provisions of this contract regardless of which specific location delivers the product. The VA staff will only need to communicate with the local and primary contractor. 4.The patient's VA physician establishes the plan of treatment in consultation with the VA Puget Sound Program for I.V. Outpatient Therapy (PIVOT) pharmacist. The plan of treatment includes information on diagnoses, treatment including procedures and medications, and precautions and limitations that affect the plan of care. The contractor shall refer all medical and procedural questions made by the patient to the VA Puget Sound PIVOT pharmacist. 5.The VA Using Service will place the initial order for a new patient and will generally reorder the Total Parenteral Nutrition (TPN) weekly until the patient is stable. Once the patient is stable, the reordering can be every two (2) weeks. If any adjustments in delivery are needed, the patient will contact the contractor directly. The contractor shall be responsible for assessing the patient(s) inventory of TPN on a weekly (for new patients) or a two (2) week cycle basis, and balance the patient(s) inventory of TPN through single or multiple item shipments, as required. 6.The contractor shall notify the PIVOT pharmacist in a within 24 hours when any relevant patient clinical concerns such as patient non-compliance, home health hazards, or significant change in patient status are noted during the implementation of this contract. 7.The contractor shall provide a telephone number (including after hours coverage) for patients to contact the contractor if there are problems with delivery or concerns with product integrity. 8.Nursing visits are not covered under this contract. 9.Should a VA physician change the patient's prescription requirements, the physician will notify the PIVOT pharmacist who will notify the contractor to make the additional necessary items to the contract. 10.The contractor shall be responsible for disposal of any unused supplies in the patient's residence after the prescription has been discontinued or changed. 11.The contractor shall maintain an accurate record for each patient to document the home care or service including supplies provided and at a minimum shall include the following: "Name, address, phone number, and social security number/claim number, of patient "Current plan of care or services "Written documentation for each service provided, indicating the date and staff person providing the care "Verbal or telephone orders recorded by a qualified individual in accordance with applicable law and regulation. 12.The contractor shall provide the number of its staff, their qualifications, and the current competence of the individuals supervising home health staff appropriate to the scope of home health service provided. 13.The contractor providing home health services, including its staff providing the service, shall have current Washington or Oregon State licenses, registrations, and certifications in accordance with applicable law or regulation. The contractor shall submit copies to the Contracting Officer with the contractor's quotation. After contract award, all changes and updated copies shall be provided to the Contracting Officer's Technical Representative (COTR) within ten (10) days of any change or update. 14.Invoices shall be submitted monthly in arrears of services performed, no later than ten (10) days following the month of service, for payment to the VA and shall reference the name, address, and social security number of the Veteran(s). TPN shipped to Veteran(s) and services provided shall be itemized as listed on the contract for all deliveries made during the month of invoice under the terms of this contract and shall be for the full cost of such services. The contractor shall not combine two different months on the same invoice. 15.The Veteran, his/her insurer, or any third party shall not be invoiced for items ordered under the terms of this contract. All items ordered under this contract shall be invoiced as indicated directly to the VA Puget Sound Health Care System, Fiscal Service (663/04), 1660 S. Columbian Way, Seattle, Washington 98108. 16.New prescriptions and prescription changes for patient(s) shall be shipped to the patient(s) residence within a twenty-four (24) hour period. 17.In the event of a national, regional, or local emergency, the contractor shall ensure that the patient shall always have at least a 24-hour supply of the prescribed TPN on hand. The contractor shall submit a copy of its Emergency Preparedness Plan to the Contracting Officer with the contractor's quotation; this plan will detail how the contractor plans to ensure continued service to TPN patients. After contract award, all changes and to the Emergency Preparedness Plan shall be provided to the COTR within ten (10) days of any change. 18.Point of delivery: Full name, phone number, and address of patient(s) will be furnished to the contractor by the Pharmacy. 19.The contractor shall be responsible for disposal of hazardous materials (i.e., needles) and TPN wastes in a safe and sanitary manner and in accordance with applicable laws and regulations. 20.The contractor shall monitor, on an ongoing basis, the patient's knowledge and performance of safety procedures, and provide appropriate instructions. The contractor shall document its monitoring. 21.The contractor shall immediately report in writing to the COTR and as appropriate to the manufacturer of supplies all accidents, malfunctions, injuries, deaths, and supply recalls, related to the provision, delivery and use of the aforementioned supplies 22.The contractor shall immediately report in writing to the PIVOT Pharmacist all dispensing errors involving VA patients. 23.The contractor shall have a recognized accreditation, such as Joint Commission Accreditation or Accreditation Commission for Health Care (ACHC), throughout the entire contract period. The contractor shall submit a copy of the accreditation with the contractor's quotation. 24.Contractor's Rights Reserved: Responsibilities of the contractor for patient care are limited to that which is described in the contract and as follows: "Coordination and supervision of employees remains the right and responsibility of the contractor "The contractor has the right to negotiate a mutually acceptable delivery or pickup with the patient 25.VA Rights Reserved: "To approve all equipment and supplies furnished to a Veteran "To cause the contractor to remove or substitute any objectionable equipment or other items "To order alteration or adjustment of a Veteran's replenishment/service program "To require reimbursement of costs for any quantities of supplies or services determined in excess of need "To add services for additional supplies at the request of the COTR, with prices to be negotiated between the VA Contracting Officer and the contractor "To conduct on-site visits to the contractor by the VA personnel and Joint Commission on Accreditation of Healthcare Organizations (JCAHO) surveyors to assess contracted services, e.g., adequacy, compliance with contract requirements, record keeping, and documentation of appropriate orientation programs for all its employees involved in the delivery, infection control procedures, patient confidentiality, handling emergencies, and all other performance areas of the contract. 26. HIPAA Applies. HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT OF 1996, PRIVACY AND SECURITY OF PROTECTED HEALTH INFORMATION (APR 2005) (a) Definitions. As used in this clause: Electronic Protected Health Information has the same meaning as the term electronic protected health information in 45 CFR 160.103. Individual has the same meaning as the term individual in 45 CFR 164.501 and shall include a person who qualifies as a personal representative in accordance with 45 CFR 164.502(g). Privacy Rule means the Standards for Privacy of Individually Identifiable Health Information at 45 CFR part 160 and part 164, subparts A and E. Protected Health Information has the same meaning as the term protected health information in 45 CFR 164.501, limited to the information created or received by the Contractor from or on behalf of The Government. Required by Law has the same meaning as the term required by law in 45 CFR 164.501. Secretary means the Secretary of the Department of Health and Human Services or his/her designee. Security Rule means the Security Standards for the Protection of Electronic Protected Health Information at 45 CFR part 160 and part 164, subpart C. Terms used, but not otherwise defined, in this Agreement shall have the same meaning as those terms in 45 CFR 160.103 164.103, and 164.304 and 164.501. (b) The Contractor agrees to not use or further disclose Protected Health Information other than as permitted or required by the Contract or as Required by Law. (c) The Contractor agrees to use appropriate safeguards to prevent use or disclosure of the Protected Health Information other than as provided for by this Contract. The Contractor agrees to implement administrative, physical, and technical safeguards that reasonably and appropriately protect the confidentiality, integrity and availability of the Electronic Protected Health Information that it creates, receives, maintains, or transmits on behalf of the Government. (d) The Contractor agrees to mitigate, to the extent practicable, any harmful effect that is known to the Contractor of a use or disclosure of Protected Health Information by the Contractor in violation of the requirements of this Contract. (e) The Contractor agrees to report to the Government any use or disclosure of the Protected Health Information not provided for by this Contract. The Contractor agrees to report to the Government any security incident of which it becomes aware. (f) The Contractor agrees to ensure that any agent, including a subcontractor, to whom it provides Protected Health Information, in any format, that it creates, receives, maintains, or transmits on behalf of the Government, agrees to the same restrictions and conditions that apply through this Contract to the Contractor with respect to such information. (g) The Contractor agrees to provide access, at the request of the Government, and in the time and manner designated by the Government to Protected Health Information in a Designated Record Set, to the Government or, as directed by the Government, to an Individual in order to meet the requirements under 45 CFR 164.524. (h) The Contractor agrees to make any amendment(s) to Protected Health Information in a Designated Record Set that the Government directs or agrees to pursuant to 45 CFR 164.526 at the request of the Government or an Individual, and in the time and manner designated by the Government. (i) The Contractor agrees to make internal practices, books, and records relating to the use and disclosure of Protected Health Information received from, or created or received by the Contractor on behalf of, the Government, available to the Government, or at the request of the Government to the Secretary, in a time and manner designated by the Government or the Secretary, for purposes of the Secretary determining the Governments compliance with the Privacy Rule. (j) The Contractor agrees to document such disclosures of Protected Health Information and information related to such disclosures as would be required for the Government to respond to a request by an Individual for an accounting of disclosures of Protected Health Information in accordance with 45 CFR 164.528. (k) The Contractor agrees to provide to the Government or an Individual, in time and manner designated by the Government, information collected in accordance with this Clause of the Contract, to permit the Government to respond to a request by an Individual for an accounting of disclosures of Protected Health Information in accordance with 45 CFR 164.528. General Use and Disclosure Provisions Except as otherwise limited in this Agreement, the Contractor may use or disclose Protected Health Information on behalf of, or to provide services to, the Government for the following purposes, if such use or disclosure of Protected Health Information would not violate the Privacy Rule or the Department of Defense Health Information Privacy Regulation if done by the Government: [List Purposes]. Specific Use and Disclosure Provisions (a) Except as otherwise limited in this Agreement, the Contractor may use Protected Health Information for the proper management and administration of the Contractor or to carry out the legal responsibilities of the Contractor. (b) Except as otherwise limited in this Agreement, the Contractor may disclose Protected Health Information for the proper management and administration of the Contractor, provided that disclosures are required by law, or the Contractor obtains reasonable assurances from the person to whom the information is disclosed that it will remain confidential and used or further disclosed only as required by law or for the purpose for which it was disclosed to the person, and the person notifies the Contractor of any instances of which it is aware in which the confidentiality of the information has been breached. (c) Except as otherwise limited in this Agreement, the Contractor may use Protected Health Information to provide Data Aggregation services to the Government as permitted by 45 CFR 164.504(e)(2)(i)(B). (d) Contractor may use Protected Health Information to report violations of law to appropriate Federal and State authorities, consistent with 45 CFR 164.502(j)(1). Obligations of the Government Provisions for the Government to Inform the Contractor of Privacy Practices and Restrictions (a) Upon request, the Government shall provide the Contractor with the notice of privacy practices that the Government produces in accordance with 45 CFR 164.520, as well as any changes to such notice. (b) The Government shall provide the Contractor with any changes in, or revocation of, permission by Individual to use or disclose Protected Health Information, if such changes affect the Contractor's permitted or required uses and disclosures. (c) The Government shall notify the Contractor of any restriction to the use or disclosure of Protected Health Information that the Government has agreed to in accordance with 45 CFR 164.522. Permissible Requests by the Government The Government shall not request the Contractor to use or disclose Protected Health Information in any manner that would not be permissible under the Privacy Rule if done by the Government, except for providing Data Aggregation services to the Government and for management and administrative activities of the Contractor as otherwise permitted by this clause. Termination (a) Termination. A breach by the Contractor of this clause, may subject the Contractor to termination under any applicable default or termination provision of this Contract. (b) Effect of Termination. (1) If this contract has records management requirements, the records subject to the Clause should be handled in accordance with the records management requirements. If this contract does not have records management requirements, the records should be handled in accordance with paragraphs (2) and (3) below. (2) If this contract does not have record management requirements, except as provided in paragraph (3) of this section, upon termination of this Contract, for any reason, the Contractor shall return or destroy all Protected Health Information received from the Government, or created or received by the Contractor on behalf of the Government. This provision shall apply to Protected Health Information that is in the possession of subcontractors or agents of the Contractor. The Contractor shall retain no copies of the Protected Health Information. (3) If this contract does not have records management provisions and the Contractor determines that returning or destroying the Protected Health Information is infeasible, the Contractor shall provide to the Government notification of the conditions that make return or destruction infeasible. Upon mutual agreement of the Government and the Contractor that return or destruction of Protected Health Information is infeasible, the Contractor shall extend the protections of this Contract to such Protected Health Information and limit further uses and disclosures of such Protected Health Information to those purposes that make the return or destruction infeasible, for so long as the Contractor maintains such Protected Health Information. Miscellaneous (a) Regulatory References. A reference in this Clause to a section in the Privacy Rule means the section as in effect or as amended, and for which compliance is required. (b) Survival. The respective rights and obligations of Business Associate under the Effect of Termination provision of this Clause shall survive the termination of this Contract. (c) Interpretation. Any ambiguity in this Clause shall be resolved in favor of a meaning that permits the Government to comply with the Privacy Rule and Security Rule. (End of Instruction)
