- Attachment 1 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested, and a written solicitation will not be issued. The Solicitation Number is TOTS10C0014, and this solicitation is issued as a Request for Quotations (RFQ) for tape loader equipment. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-39. This procurement is unrestricted with the assigned North American Industry Classification System code 541519, Other Computer Related Services, and the small business size standard $25 million. The Contractor shall deliver the items in Attachment 1 to the Office of Thrift Supervision, 1700 G Street, NW, Washington, DC 20552 no later than thirty (30) days after award. The selected Offeror must comply with the following commercial item terms and conditions. FAR 52.212-1, Instructions to Offerors - Commercial; FAR 52.212-2, Evaluation-Commercial Items; FAR 52.212-4, Contract Terms and Conditions - Commercial Items; and 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items (see attachment for 52.212-5 applicable clauses) apply to this acquisition. The selected Offeror must submit a completed copy of the provision at 52.212-3, Offeror Representations and Certifications - Commercial Items. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the government, price and price related factors considered. Evaluation Factors (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (1) Price. (b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
