- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes/offers are being requested and written solicitation will not be issued. The Black Hills Health Care System, Fort Meade Campus, is soliciting offers for the following requirement; weed control, grass and tree fertilization and tree insect control per the Scope of Work. The government will award a firm-fixed-price (FFP) contract resulting from the solicitation to the responsible offeror whose offer conforms to the solicitation and results in the lowest price. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time specified for acceptance, shall result in a binding contract without further action by either party. The government may elect to award without discussions. The contract will be awarded on or about May 14, 2010. The Statement of Work, Bid Schedule and Wage Determination will be issued upon request. The magnitude of the project is between $25,000 and $100,000. The North American Industry Classification System (NAICS) code is 561730, and the small business size standard is $7.0 million. This solicitation is set-aside 100% for small business with the expectation that there will be one award supporting this acquisition. Additional Relevant Contract Provisions/Clauses: The following apply to this acquisition: FAR 52.212-1, Instructions to Offerors Commercial Items; FAR 52.212-3, Offeror Representations and Certification Commercial Items; FAR 52.212-4, Contract Terms and Conditions Commercial Items; and FAR Part 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items. In paragraph (a) of FAR 52.212-5 the following applies: FAR 52.233-3, Protest After Award; and FAR 52.233-4 Applicable Law for Breach of Contract Claim. In paragraph (b) of FAR 52.212-5 (b), the Contractor shall complete with the following FAR clauses that the Contracting Officer has indicated as being incorporated in this contract by reference to implement provisions of law or Executive order applicable to acquisitions of commercial items: FAR 52.222-2 Convict Labor; FAR 52.222-19 Child Labor; FAR 52.222.21 Prohibition of Segregated Facilities; 52.222-26 Equal Opportunity; 52.232-33, Payment by Electronic Funds Transfer-Central Contractor Registration. In paragraph (c) of FAR 52.212-5 (c), the following applies: FAR 52.222-41, Service Contract Act of 1965. FAR 52.222-43 Fair Labor Standards Act and Service Contract Act Price Adjustment. The Federal Acquisition Regulation clauses and provisions are available on the internet at: http://www.arnet.gov/far, and they will be incorporated into final contract award documents as appropriate. Wage Determination 12005-2485, Revision No.7, dated 08/28/2009 for Meade County, South Dakota, is applicable to this solicitation and resulting award. Offers are due by 3:00 PM, MST, May 12, 2010, unless amendments are issued extending the due date. Paper copies of this combined Synopsis/Solicitation will not be issued. The government reserves the right to cancel this Synopsis/Solicitation.
