Description
THIS IS A MODIFICATION TO THE COMBINED ANNOUNCEMENT FOR SOLICITATION NUMBER N8364109999. THE MANUFACTURER'S SPECIFICATIONS ARE AVAILABE BY EMAIL REQUEST TO BARBARA_ESCHELS@NPS.GOV FOLLOWING IS THE JUSTIFICATION FOR USE OF A BRAND NAME: JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITIONOver $100,000 1.Identification of the Agency and the Contracting Activity:Department of the InteriorNational Park ServiceLake Mead NRABoulder city, NV 89005 2.Nature and/or Description of the Action Being Approved:This project is in response to a flood event that happened with no notification or warning in the Cottonwood area. After close analysis of the area there were holes in our current systems coverage of the area. The work being accomplished will add additional coverage to the existing flash flood system at Cottonwood Cove, correct the deficiencies in the current system and upgrade the current system to include a new automated system and additional monitoring sensors integrated with existing sensors that would trigger or activate sirens when more than 1 - 2 sensors are set off. 3.A Description of the Supplies or services Required to Meet the Agency's Needs, Including the Estimated Value:A certified HydroLynx installer to provide and install all equipment, software, programming telemetry radios, integration of the HydroLynx flash flood warning system at Cottonwood Cove and the parks system. This project will add two channel flow monitors, rain gauge, and central siren system. All completely interfaced/integrated wirelessly with each other, the existing system, and the dispatch center as to trigger a flash flood event prevent false alarms and provide immediate automated response. The Scope of Work includes an estimate of $149,000, providing concrete support walls are needed for the monitoring stations. 4.An Identification of the Statutory Authority Permitting Other Than Full and Open Competition: FAR 6.302-1(c) Application for Brand Name Descriptions 5.A Demonstration That the Proposed Contractor's Unique Qualifications or the Nature of the Acquisition Requires Use of the Authority Cited: Hydrolynx as with all Flash Flood Systems is proprietary. Therefore, other companies equipment may not be compatible with the current system. This project is to integrate additional monitors and sirens into the existing system. Selecting a different system or manufacturer would require replacement of the whole system at Cottonwood Cove which would escalate the project to an estimated three times the cost of this current project. Another manufacturer would have to include adding special telemetry radio repeaters, new licensing for the frequencies through NTIA, increase solar power & batteries on mountain top radio sites, basically duplicating part of the existing backhaul radio system. The existing system is monitored by more than one mountain top site for redundancy, so new equipment would be needed to support the additional system. In addition, a new software package would be needed in the dispatch center to monitor the new system which could cause issues with two flash flood software programs running at the same time along with a myriad of other programs being run on the dispatch centers computers at the same time. Furthermore, additional testing equipment, factory training for service technicians and additional spare parts will be needed, creating an unnecessary expense for the Government. Finally, the dispatch center staff would need to be trained on the additional system, again an unnecessary expense. 6.A Description of Efforts Made to Ensure that Offers Are Solicited From as Many Potential Sources as is Practicable, Including Whether a Notice Was or Will Be Publicized as Required by FAR Subpart 5.2 and, If Not, Which Exception Under FAR 5.202 Applies: The existing system was procured using full and open competition in 2005. The current procurement to upgrade the software and add new equipment will be synopsized in accordance with FAR 5.102(a)(6), which states that the justification shall be uploaded for electronic review with the solicitation package. 7.A Determination by the Contracting Officer That the Anticipated Cost to the Government Will Be Fair and Reasonable: A review of catalog or internet pricing of the competition would provide back-up documentation that the pricing received from HydroLynx is fair and reasonable. Furthermore, HydroLynx is the system manufacturer, thus saving money when working with a third party. 8.A Description of the Market Research Conducted (see FAR Part 10) and the Results or a Statement of the Reason Market Research Was Not Conducted: Market research was not conducted. The current warning system was manufactured and installed by HydroLynx. The HydroLynx system uses proprietary software to operate. 9.Any Other Facts Supporting the Use of Other Than Full and Open Competition (see FAR 6.302-2 (9) (i) - (iii) for some examples): In accordance with FAR 6.302-1(c), An acquisition that uses a brand name description or other purchase description to specify a particular brand name, product, or feature of a product, peculiar to one manufacturer does not provide for full & open competition regardless of the number of sources solicited. The above description is essential to the Government's requirements, thereby precluding consideration of a product manufactured by another company. 10. A Listing of the Sources, If Any, That Expressed in Writing, an Interest in the Acquisition: NONE 11. A Statement of the Actions, If Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for the Supplies or Services Required: A New System is not cost effective or feasible at this time.
