- NASA intends to extend Contract NNA04BC25C with Eloret Corporation on a sole-sourcebasis pursuant to 10 U.S.C 2304(c)(1), Only One Responsible Source, in support of AmesResearch Center's (ARC) Code TS, Space Technology Division, for a period of six months(May 1, 2010 through October 31, 2010), while the Government Accountability Office (GAO)considers a protest of the April 1, 2010 award of the follow-on contract, NNA10DE12C, toERC Corporation. The current Contractor provides the following mission critical support services under Space Technology Research and Development (STRAD). The principalpurpose of this contract is to support the Space Technology Division at NASA AmesResearch Center to obtain the services needed for the development of technologies for usein the design and fabrication of prototype vehicles that travel at hypervelocities in theatmosphere of Earth and other bodies in the solar system. The Contractor provides supportin the areas of Reacting Flow Environments, Nanotechnology, Thermo-Physics Facilities,and Thermal Protection Materials and Systems. This extension will allow for acontinuation of services to ensure program continuity and critical mission support and toavoid significant technical impacts while a protest to the General Accountability Officeof the award of the follow-on acquisition is completed. The extension will extend the period of performance of the current contract, NNA04BC25C,for a period of six months, from May 1, 2010, through October 31, 2010, and increase thecontract value accordingly. The current contractor, Eloret Corporation, is considered theonly contractor that can meet ARCs needs given the short period of performance for theextension. Awarding a six-month contract to another source, at the same the GAO protestis under review, would result in substantial duplication of costs and unacceptable delaysin fulfilling the Governments requirements and not allow for a sufficient phase-inperiod, thereby affecting the continuity of services and causing unacceptable delays infulfilling ARCs requirements. The proposed contract action is for supplies or services for which the Government intendsto solicit and negotiate with only one source under the authority of FAR 6.302. Thepurpose of this action is to bridge the performance period between the end of the currentcontract, the adjudication of the GAO protest, completion of any resultant corrective,and phase-in of a new contract. This notice of intent is not a request for competitive proposals. A determination by theGovernment not to compete this proposed effort on a full and open competition basis,based upon responses to this notice, is solely within the discretion of the government. Notwithstanding this stated intent, interested organizations may submit theircapabilities and qualifications to perform the effort in writing to the identified pointof contact IN WRITING to the identified point of contact not later than 4 PM PST on April29, 2010. Such communication of capabilities/qualifications will be evaluated solely forthe purpose of determining whether or not to conduct this procurement on a competitivebasis. Oral communications are not acceptable in response to this notice. The Governmentdoes not intend to acquire a commercial item using FAR Part 12.
