- NASA Johnson Space Center (JSC) has a requirement for one (1) ton of NitrogenOxides (NOx) Emission Reduction Credits (ERC) that have been certified by the TexasCommission on Environmental Quality (TCEQ) that are available for purchase within theHouston, Texas; Galveston Texas; and Brazoria County Air Shed (HGB). NASA is requestingquotes from all parties that are interested in selling one (1) ton of NOx ERC.This proposed contract is unrestricted. Responses are being accepted from all firms. Thecontract resulting from this solicitation will be a Firm Fixed Price (FFP) contract. Thecontract will be for the purchase of 1.0 ton per year of Emission Reduction Credits(ERC's) for Nitrogen Oxides (NOx) in the Houston/Galveston/ Brazoria air shed.Minimumquantity shall not be less than 1.0 ton/yr. The successful offeror(s) will be based onthe lowest price that meets the following minimum requirements: (1) Transfer to theNational Aeronautics and Space Administration (NASA) the proposed 1.0 ton per year of NOxERCs that meet the stated requirement that are currently banked with the TexasCommission on Environmental Quality (TCEQ) pursuant to 30 Texas Administrative Code (TAC)Chapter 101 Subchapter H, Division 1 Emission Credit Banking and Trading. The ERC'smust be certified in the TCEQ Credit Registry and shall be determined by the TCEQ to besurplus, permanent, quantified and federally enforceable reductions in emissions. Credits with an expiration date of less than 90 days from delivery are not acceptable. In addition to the above paragraph, the ERC's shall be otherwise fully recognized byappropriate federal, state and local authorities as legally valid for use as analternative means of compliance with NOx reduction requirements to the extent allowed inChapter 117 pertaining to the control and abatement of air pollution. Transfer of bankedemission reductions shall be made pursuant to 30 TAC 101.309 and banked ERC's shall betransferred by the means permitted by TCEQ. The contractor shall provide evidence to theGovernment that the TCEQ has been informed, in writing, of the transfer and that thetransfer has been recorded in the TCEQ Credit Registry. The transaction shall be completeupon NASAs receipt of confirmation of transferred ERC's from the TCEQ. The contractorshall be responsible for all banking application fees and banked emission transferapplication fees and must be able to meet required delivery date and FOB terms. (2) Theofficial transfer process for the ERC's shall be initiated with the TCEQ within ten (10)working days after date of contract and shall be delivered (i.e. transfer complete) nolater than fourteen (14) calendar days after contract award, exclusive of delays solelyattributed to NASA. Registration of the ERC's in the registry system will constitutecertification.All certificates shall be registered to the National Aeronautics andSpace Administration, Customer Number CN601572878 and delivered to NASA Johnson SpaceCenter, JSC Environmental Office, Mail code JE-111, Attn: Kirk Hummel at 2101 NASAParkway, Houston, TX 77058-3696.Questions regarding this acquisition must be submitted in writing (e-mail is preferred)no later than May 3, 2010. (Prospective quoters shall notify this office of their intentto submit a quotation. It is the quoter's responsibility to monitor this site for therelease of amendments (if any). Potential quoters will be responsible for downloadingtheir own copy of this notice.This notice is a combined synopsis/solicitation for commercial items prepared inaccordance with the format in FAR Subpart 12.6, as supplemented with additionalinformation included in this notice. This announcement constitutes the onlysolicitation, which is issued as a Request for Quotation (RFQ); quotes are beingrequested and a written solicitation will not be issued. Offerors are required to usethe On-Line RFQ system to submit their quote. The On-line RFQ system is linked above orit may be accessed at http://prod.nais.nasa.gov/cgi-bin/eps/bizops.cgi?gr=C&pin=. The information required by FAR Subpart 12.6 is included in the on-line RFQ.The Government intends to acquire a commercial item using FAR Part 12 and the SimplifiedAcquisition Procedures set forth in FAR Part 13.Questions regarding this acquisition must be submitted in writing (e-mail is preferred)no later than May 3, 2010.
