Description
This contract action was accomplished using other than competitive procedures because there is only one responsible source as this contract is for utilities, and no other supplies or services will satisfy agency requirements. (FAR 6.302-1). See posted J&A for further information. FOR OTHER THAN FULL AND OPEN COMPETITION 1. CONTRACTING AGENCY -Department of Army US Army Corps of Engineers Fort Worth District Contracting Division Fort Worth, Texas 76102 2. DESCRIPTION OF ACTION The approval is being requested for electrical improvements due funding received by the American Recovery and Reinvestment Act to renovate campgrounds at Proctor Lake. Furnish all tools, labor, material and equipment to provide electrical system enhancements to Copperas Creek Park and Promontory Park. This improvement will include installation of two new metering points, replacing 11 pole transformers with ground mounted transformers, replacing two pole transformers and relocating two metering locations. It is estimated to be completed within 18 months. The schedule of this work will parallel the construction work to be initialized under the American Recovery and Reinvestment Act of 2009. Jim Lester, Staking and Mapping Engineer for the Comanche Electric Cooperative Association, is the POC on this project and his contact number is 1-800-915-2533. Value is not to exceed $80,000. 3. DESCRIPTION OF SERVICES - Comanche Electric Cooperative Association (CECA) will be removing eight -167KVA & a 25KVA existing overhead transformers and poles, removing four poles with lighting arresters and removing two service poles, downgrading eight demand meters and removing 140 LF of primary line at the group use area. CECA will be installing ten - 37.5KVA ground mounted transformers with concrete pads, two 25KVA ground mounted transformers with pads, four ground-mounted junction boxes with slabs, one steel pole with 37.5 KVA areal transformers and four steel posts around every pad transformer. CECA will also install an estimated 559LF of primary line in Government provided pipe and ditch. CECA will provide twelve 200-320 Amp meter bases and make all primary side connections and material for electrical service. 4. AUTHORITY CITED - 10 USC 2304(c)1, as implemented by FAR 6.302-1(b)(3); State and Federal agencies created franchise territory that dictate that one utility company will provide service and provide construction work on their system. 5. REASON FOR AUTHORITY CITED - Comanche Electric Cooperative Association is the owner of the power distributions lines in this area and has successfully operated and maintained hundreds of miles of electric power lines for decades. The Texas Utility Commission requires CECA to own and maintain the existing power lines in this area; therefore, when a customer requests power changes to the existing lines, that customer is responsible for paying for any upgrades associated with the requirement. All the work identified in this J&A will be preformed by CECA employees. 6. EFFORTS TO OBTAIN COMPETITION - Because of electrical deregulation, there are now many electric service providers for electricity (power), but only one owner of the power distribution lines in this area, which is CECA. Therefore, any power work must be performed via CECA, as CECA will not allow another companies to upgrade or perform work their power lines. 7. ACTIONS TO INCREASE COMPETITION - No other actions pursued to increase competition. 8. MARKET RESEARCH - The Government has contacted CECA and verified the information provided herein. 9. INTERESTED SOURCES - The authority at 10 U.S.C.2304(c)(1), only one source can perform this particular requirement, because the power line ownership was not deregulated, and therefore the owner has the authority to allow or, as in this case, disallow another party to perform upgrades on the utility lines. The notice will be published. 10. OTHER FACTS - CECA has the necessary prerequisite knowledge of the power grid, system design and load capacity to make changes or modifications on the power system.
