Description
NOTE: The purpose of this amendment is to inform potential offerors of the extension of the solicitation to May 21, 2010, and to provide responses to new questions that have been presented by potential offerors. This office is currently working on revisions to the solicitation. Once completed, the revised solicitation package will be posted on FedBizOpps (FBO) with the new offer due date and time of receipt. New questions from potential offerors: 1. Did the Contracting Officer ever receive requests to conform specific positions that may not have been on the applicable wage determination as a result of any of the Department of Labor (DOL) Wage Determinations published over the life of the contract? If so, what did that process involve? If there were no requests received, it would be helpful to know that as well. Government Answer: The Contracting Officer never received any requests to conform specific positions that may not have been on the applicable Wage Determination as a result of any of the DOL Wage Determinations published over the life of the contract. 2. With multiple hospitals having large numbers of position description that probably varied from those on the Wage Determination, how are decisions made about which positions, if any, need to go through the conformance process described by DOL? Government Answer: The conformance process described by DOL falls under 29 CFR 4.6 and 29 CFR 4.152. According to DOL, if the positions or jobs are not on the Wage Determination, then the positions need to go through the conformance process. 3. What happens when the actual hourly rate for a particular position of the Contractor is found to be below that of the comparable position on the Wage Determination. Specifically, if the rate determined by DOL is based on a geographical area that is significantly different from the market area that a Contractor bases its wages on, what steps are available for a Contractor to justify the wage variance? Government Answer: According to DOL, whatever rate(s) is in the Wage Determination is the rate(s) as long as they classified it in the right geographical area for the particular contract.
