- Synopsis: This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 05-40. The Solicitation number VA-244-10-RP-0215 is issued as a sole source, request for proposal. This acquisition is a sole source to Covidien, maker of ForceTriad electrosurgical equipment, under NAICS code 339112, which has a small business size of 500 employees. The technology device required will primarily be used to ligate vessels and divide tissue laparoscopically. Without this device, patients will likely experience prolonged recovery time and more time spent in the hospital. This device works better for patients because it provides an optimized combination of pressure and energy that works with the vessel to create a permanent, plastic-like seal. This permanent seal leaves no foreign material behind, which otherwise could interfere with the healing process. This device also reduces blood loss in some surgical procedures as well as the risk of needle stick injuries. Other electrosurgical devices are not as effective and therefore cause greater risk to our patients. Controlling the bleeding with cautery is not as durable and risks injury to the bowel. Staples are costly and are not feasible in all surgical situations. The following items are being procured: 1) 1 Electrosurgical apparatus EIL: ForceTriad 2) 1 ForceTriad mounting cart: FT900 3) 1 FTSW SGLE Ligasure: LS0300 4) 1 Bipolar GEM Footswitch: E6019 5) 1 Standard Footswitch: E6008 The requested items need to be delivered, on May 28, 2010 or earlier, to the Erie VAMC at the following address: Erie VAMC 135 East 38th Street Erie, PA 16504 The provision at 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition; there are no addenda. Offerors should include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items, with their offer. The clause 52.212-4, Contract Terms and Conditions-Commercial Items, applies to this acquisition; there are no addenda. The clause 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition. The following numbers indicate the specific references in this clause that are applicable to this acquisition: 19, 20, 21, 22, 24, 30, 33, and 39.
