- The Broadcasting Board of Governors (BBG) intends to negotiate and award a non-competitive contract to Phoenix Air Group, Inc. (PAG), located in Cartersville, GA. The above is being done in accordance with FAR 6.302-1, under the authority of 41 U.S.C. 253(c)(1), other than full and open competition, as only one (1) responsible source and no other supplies or services will satisfy the Agency's requirements. Presently, PAG provides an airborne broadcast platform referred to as 'AeroMarti' with installed U.S. Government television transmission systems that are operational utilizing two (2) PAG-owned Grumman Gulfstream I turboprop aircraft. PAG had an instrumental role and provided expert services in the development and operation the AeroMarti airborne TV broadcast platform. Under a Task Order to an Army contract, which was awarded on July 28, 2006 and expires completely on May 31, 2010, PAG has provided the necessary air services to AeroMarti and has become fully aware of the complex operational and technical challenges associated with maintaining the AeroMarti schedule, which includes 6 days a-week airborne television broadcasting. This includes the operations of the onboard broadcast system in compliance with FCC Memorandum Opinion and Order No. 95-160, dated April 28, 1995, that mandates that the Agency maintain a 'directional' TV signal broadcast to insure no objectionable interference to any domestic FCC licensee. The Period of Performance will be one (1) year from June 1, 2010 through May 31, 2011. Funding will be provided for the period covering June 1, 2010 through November 30, 2010. Performance after November 30, 2010 will be subject to the availability of Fiscal Year (FY) 2011 funding. Under the non-competitive contract, PAG shall provide all supervision, labor, tools, equipment, materials, documentation, supplies, services testing, licenses, permits, parts, materials and shipping as necessary to perform the AeroMarti directed television broadcast missions using the two (2) PAG-owned Grumman Gulfstream I turboprop aircraft. PAG shall be responsible for conducting all directed AeroMarti broadcast missions, perform all necessary aircraft maintenance, and submit a variety of monthly reports that will address actual flight hours, cost reimbursable charges, daily fueling reports, receipts, and summaries. Interested sources shall have prior demonstrated and documented experience in delivering to (or providing) an international broadcast operation with high powered television directional antenna systems required by AeroMarti for the U.S. Government. Interested firms shall identify their business size (i.e., small, large, etc.) and submit a comprehensive written 'Capabilities Statement' that is verifiable by the BBG in order to determine if the interested source is responsive to this notice. The 'Capabilities Statement' must include, at the minimum, the following: (1) Evidence of specific examples of the Contractor's successful PAST PERFORMANCE, (2) with a minimum of five (5) years experience in providing specialized TV Air Services support; (3) SAMPLE PROJECT PLAN to include, but not limited to; an operations and maintenance schedule, on-site list of materials, aircraft support equipment, description of activities performed, and a budgetary estimate, (4) PAST PROJECTS: within last two (2) year's list the project title, city, state, country, customer's name, contract type, total contract amount, contract start and completion dates, summary of the description of the specialized TV air services, (5) REFERENCES: provide the names and title, current address, city, state, country, email and telephone number of the customer point-of-contact, (6) TECHNICAL PERFORMANCE: The Contractor shall clearly describe their ability to provide specialized TV air services support and submit appropriate technical documentation describing the ability of all proposed team members for the above, (7) AIRCRAFT: provide evidence of having immediate access to the required Grumman Gulfstream I turboprop aircraft, and (8) Those interested may specify a description or listing of specific information that they would require for the above. This Notice is not a request for competitive price proposals. If it is determined to be in the best interest of the Government, interested and qualified sources responding to this Notice may be requested to provide follow-up information. Interested sources who respond will be notified on whether their written 'Capabilities Statement,' as verified by the BBG is responsive to this notice. A determination to compete, or not to compete, this requirement will be based on responses to this Notice and is solely within the discretion of the Government.
