This solicitation document and incorporated provisions and clauses are those in effect through the Federal Acquisition Circular (FAC) 2005-41, Defense Federal Acquisition Regulation Supplement Change Notice (DCN) 20100430, and Air Force Acquisition Circular (AFAC) 2010-0402. This announcement constitutes the only solicitation. Proposals are being requested and a written solicitation will not be issued. The solicitation number for this procurement is FA4855-10-Q-0003 and is a Request for Proposal (RFP). Submit written offers only, oral offers will not be accepted. All firms or individuals responding must be registered with the Central Contractor Registration (CCR). Information concerning CCR registration requirements may be viewed via the internet at http://www.ccr.gov or by calling the CCR Registration Center at 1-888-227-2423. This solicitation is a set-aside 100% for small business. The North American Industry Classification System (NAICS) is 541380 Testing Laboratories. Small Business Size Standard is $12M. Only one contract will be awarded. This requirement is for five (5) years: Base Year plus 4-one year options. It is the firm's or individual's responsibility to be familiar with applicable provisions and clauses. All FAR Provisions and Clauses may be viewed in full text at the Federal Acquisition Regulation Table of Contents via the Internet at http://farsite.hill.af.mil/. Shipping should be included in quote. The Government will award a firm-fixed price contract resulting from this combined synopsis/solicitation to the responsible offeror whose offer conforming to the synopsis/solicitation will be the most advantageous to the Government, price and other factors considered. Award shall be based on All or None and Best Value to the Government. Best value can include but is not limited to price, delivery date, and technical capability, if specified. All items shall be delivered FOB Destination to 109 E Trident Ave, Bldg 772, Cannon AFB NM 88103. This solicitation is for the procurement of: ANALYTICAL SERVICES TO BE PROVIDED: The listed test methods and EPA methods are those primarily used by 27 SOCES/CEAN and are not necessarily limited to other methods, nor do they reflect the most current EPA methods which may be available to the Contractor. Contractor is encouraged to provide 27 SOCES/CEAN with a current menu of test methods, EPA methods and/or services available in respect to the Statement of Work for incorporation into this contract. The following services are to support Cannon AFB by providing sampling and chemical analysis of soil, water, oil-water separators, hazardous and solid wastes. All sampling and analysis shall be accomplished in accordance with appropriate laboratory methods, ASTM Standard, Environmental Protection Agency (EPA) publication SW-846 as required in 40CFR 260 through 270 and/or current Federal and State regulations at the time services rendered. All test methods used shall be either those specified or subsequent, improved methods accepted by the EPA. A Chain of Custody shall be used to assure integrity of analytical results. Final test report shall be mailed to 27 SOCES/CEAN within 15 days. Status reports on analysis in progress will be provided by the Contractor upon Government request. Prices for each analytical analysis listed in the Contract Line Items (CLINs) and SubCLINs' menu include all required sample preparation methods except where otherwise noted. See attached Statement of Work (SOW) at Attachment 1. (End of Provision) FAR 52-212-3 Offeror Representations and Certifications -- Commercial Items Complete only paragraph (j) of this provision if the annual representations and certificates have been completed electronically at http://orca.bpn.gov. If the annual representations and certifications has not been completed electronically at the ORCA website, then only paragraphs (b) through (i) of this provision need to be completed. 52.212-4(c) 52.212-4 ADDENDUM CONTRACT TERMS AND CONDITIONS - COMMERCIAL ITEMS (MAR 2009) (FAR Clause 52.212-4 is tailored in accordance with 12.302(d)) FAR 52.212-4, Paragraph (c) is tailored as follows: (c) Changes. Changes in terms and conditions of this contract may be made only by written agreement of the parties with the exception of administrative changes such as changes in paying office, appropriations data, etc., which may be changed unilaterally by the Government. Furthermore, the Government may exercise option clauses FAR 52.217-8 entitled "Option to Extend Services" and FAR 52.217-9 entitled "Option to Extend the Terms of the Contract" unilaterally. The Government may use FAR Clause 521.216-18 entitled "Ordering" to de-obligate any excess funds unilaterally. (End of addendum) FAR 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000) (a) The Government may extend the terms of this contract by written notice to the Contractor within 15 days; provided that the Government gives the Contractor a preliminary written notice of its intent at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years and 6 months. (End of clause) FAR 52.222-42 Statement of Equivalent Rates for Federal Hires In compliance with the Service Contract Act of 1965, as amended, and the regulations of the Secretary of Labor (29 CFR Part 4), this clause identifies the classes of service employees expected to be employed under the contract and states the wages and fringe benefits payable to each if they were employed by the contracting agency subject to the provisions of 5 U.S.C. 5341 or 5332. THIS STATEMENT IS FOR INFORMATION ONLY: IT IS NOT A WAGE DETERMINATION Employee Class Monetary Wage-Fringe Benefits Environmental Protection Specialist GS-0028-09 $23.05/hr (End of clause) FAR 52.228-5 - Insurance--Work on a Government Installation. As prescribed in 28.310, insert the following clause: Insurance -- Work on a Government Installation (Jan 1997) (a) The Contractor shall, at its own expense, provide and maintain during the entire performance of this contract, at least the kinds and minimum amounts of insurance required in the Schedule or elsewhere in the contract. (b) Before commencing work under this contract, the Contractor shall notify the Contracting Officer in writing that the required insurance has been obtained. The policies evidencing required insurance shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the Government's interest shall not be effective -- (1) For such period as the laws of the State in which this contract is to be performed prescribe; or (2) Until 30 days after the insurer or the Contractor gives written notice to the Contracting Officer, whichever period is longer. (c) The Contractor shall insert the substance of this clause, including this paragraph (c), in subcontracts under this contract that require work on a Government installation and shall require subcontractors to provide and maintain the insurance required in the Schedule or elsewhere in the contract. The Contractor shall maintain a copy of all subcontractors' proofs of required insurance, and shall make copies available to the Contracting Officer upon request. (End of Clause) FAR 52.232-19 Availability of Funds For The Next Fiscal Year (Apr 1984) Funds are not presently available for performance under this contract beyond 31 May 2011. The Government's obligation for performance of this contract beyond that date is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise for performance under this contract beyond 31 May 2011, until funds are made available to the Contracting Officer for performance and until the Contractor receives notice of availability to be confirmed in writing by the Contracting Officer. FAR 52.233-4 Applicable Law for Breach of Contract Claim: United States law will apply to resolve any claim of breach of this contract.
